Code and sentenced him to undergo Rigorous<br \/>\n\tImprisonment for 7 years with fine of Rs.5,000\/- i\/d to further<br \/>\n\tundergo RI for 6 months and also held the appellant   accused<br \/>\n\tguilty for the offence under Section 489(c) and sentenced him to<br \/>\n\tundergo RI for 5 years with fine of Rs.3,000\/- i\/d to further<br \/>\n\tundergo RI for 3 months. The learned Judged has also ordered that<br \/>\n\tall the sentence awarded to the accused shall run concurrently.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the case of prosecution are that on the date of<br \/>\n\tincident the complainant   ASI, along with other police personnel<br \/>\n\twere on Bank Watch Petrolling, at that time at Vapi GIDC near State<br \/>\n\tbank of India Cross road three persons were coming in suspicious<br \/>\n\tcondition and were dealing in money and, therefore, they were<br \/>\n\tstopped by the complainant and others and asked as to why they are<br \/>\n\tstanding near the Bank. They did not give proper and satisfactory<br \/>\n\treply. As the appellant and others were having currency notes of<br \/>\n\tdenomination of thousand rupees and different currency notes they<br \/>\n\twere taken to SOG office. Thereafter two panchas were called and in<br \/>\n\ttheir presence and in presence of PSI and others fake and duplicate<br \/>\n\tnotes were recovered from the accused. It is alleged by the<br \/>\n\tprosecution that the said fake and bogus currency notes were brought<br \/>\n\tfrom neighbouring countries. The complaint was registered against<br \/>\n\tthe accused and other persons with Vapi GIDC Police Station which<br \/>\n\tcame to be registered as CR No. I -74 of 2007.\n<\/p>\n<p>Necessary<br \/>\n\tinvestigation was carried out by the Police and after completion of<br \/>\n\tinvestigation the charge-sheet against the accused came to be<br \/>\n\tsubmitted before the Court of learned Magistrate. As the offence<br \/>\n\tunder Sections 489(A)(B)(c) read with Section 120-B I.P. Code are<br \/>\n\texclusively triable by the Court of Sessions, the learned Magistrate<br \/>\n\tcommitted the said case to the Court of Sessions at Valsad. The<br \/>\n\tlearned Additional Sessions Judge framed the charge against the<br \/>\n\taccused. The accused pleaded not guilty to the charge and claimed to<br \/>\n\tbe tried.\n<\/p>\n<p>To<br \/>\n\tprove the case against the accused the prosecution has examined 6<br \/>\n\twitnesses and also relied upon documentary evidence and at the end<br \/>\n\tof trial, after recording the statement of the accused under Section<br \/>\n\t313 Cr. P.C., and after hearing the arguments on behalf of the<br \/>\n\tprosecution and the defence, the learned Additional Sessions Judge<br \/>\n\theld the appellant   accused guilty of the offences charged<br \/>\n\tagainst him and awarded sentence as narrated herein above.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the aforesaid Judgment and order<br \/>\n\tof conviction and sentence the appellant   accused has preferred<br \/>\n\tthis Appeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate Mr. Mrudul Barot for  appellant and learned APP Mr.<br \/>\n\tH.H. Parikh on behalf of the respondent   State. I have gone<br \/>\n\tthrough the Judgment and order passed by the trial Court. I have<br \/>\n\talso considered the documents produced on the record of the case.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate, appearing on behalf of the appellant   accused, has<br \/>\n\tcontended that he is not arguing the matter on merit. However, he<br \/>\n\thas contended that the accused is poor and layman and he cannot<br \/>\n\tunderstand the local language. This is his first offence and he is<br \/>\n\tfalsely involved in the case. He has contended that since last 3<br \/>\n\tyears and four months the accused is in Jail and looking to the<br \/>\n\tfacts of the case some mercy is required to be shown and the<br \/>\n\tsentence which the accused has already undergone may be treated as<br \/>\n\tsentence and he may be set at liberty forthwith.\n<\/p>\n<p>Learned<br \/>\n\tAPP has supported the Judgment and roder passed by the Sessions<br \/>\n\tCourt and contended that looking to the seriousness of offence no<br \/>\n\tinterference is required to be called for by this Court.\n<\/p>\n<p>I<br \/>\n\thave gone through the Judgment and order passed by the learned<br \/>\n\tAdditional Sessions Judge and also gone through the documents<br \/>\n\tproduced before me. I have also considered the submissions made by<br \/>\n\tthe learned Advocates for the parties.\n<\/p>\n<p>Looking<br \/>\n\tto the facts and circumstances of the case and looking to the fact<br \/>\n\tthat since last about 3-1\/2 years the appellant   accused is in<br \/>\n\tjail, if the sentence already undergone by the appellant   accused<br \/>\n\tbe treated as sentence the same would meet with the ends of justice.\n<\/p>\n<p>Accordingly,<br \/>\n\tthis Appeal is partly allowed. The Judgment and order dated<br \/>\n\t12.06.2008 passed by the learned Additional Sessions Judge, Fast<br \/>\n\tTrack Court, Valsad, in Sessions Case No.78 of 2007 is confirmed.<br \/>\n\tHowever, the sentence awarded to the appellant   accused by the<br \/>\n\tSessions Court is modified to the extent that the sentence which the<br \/>\n\tappellant   accused has already undergone may be treated as<br \/>\n\tsentence and the appellant   accused be set at liberty forthwith<br \/>\n\tif he is not required to be detained in any other case.
