Nos.1510 of 2009 &amp; 25, 339 of 2010\n   ------------------------------------------------\n       Dated this the 30th day of July, 2010\n\n                   JUDGMENT\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>     The claimants are in appeal. Their wet lands<\/p>\n<p>in Kaduthuruthy village were acquired for the<\/p>\n<p>purpose of construction of Government Poly<\/p>\n<p>Technic at Kaduthuruthy. The relevant Section 4<\/p>\n<p>(1) notification was published on 04\/11\/03. The<\/p>\n<p>Land Acquisition Officer awarded land value at the<\/p>\n<p>rate of Rs.926\/- per Are. Before the Reference<\/p>\n<p>Court, the claimants adduced evidence and Ext.A1<\/p>\n<p>document     in  LAR.160\/05       corresponding    to<\/p>\n<p>LAA.1510\/09 and Ext.C1 commission report were<\/p>\n<p>the two items which were relied on mostly by the<\/p>\n<p>L. A. A. No.1510 of 2009 &amp; con. cases -2-<\/p>\n<blockquote><p>      claimants.      Ext.A1      was    a  sale deed   dated<\/p>\n<p>      15\/07\/02. A copy of Ext.A1 is handed over to us<\/p>\n<p>      by Sri.Francis Joseph Kurisunkal, the learned<\/p>\n<p>      counsel       for    the      appellant.  Even   though<\/p>\n<p>      Sri.Kurisunkal submitted that Ext.A1 relates to<\/p>\n<p>      wet lands, having gone through Ext.A1 we are not<\/p>\n<p>      in a position to accept his submission. We hold<\/p>\n<p>      that Ext.A1 relates to reclaimed land. Ext.A1<\/p>\n<p>      reveals land value of Rs.7,407\/- per Are. But as<\/p>\n<p>      already stated, the acquired property unlike<\/p>\n<p>      Ext.A1 property was only wet land. The appellant<\/p>\n<p>      did not produce any document pertaining to wet<\/p>\n<p>      lands reflecting value higher than what is awarded<\/p>\n<p>      by the Land Acquisition Officer. Under Ext.C1<\/p>\n<p>      Commissioner reported that the acquired property<\/p>\n<p>      and     the    property       covered   by  Ext.A1  are<\/p>\n<p>L. A. A. No.1510 of 2009 &amp; con. cases -3-<\/p>\n<\/blockquote>\n<blockquote><p>      comparable.        The     learned  Subordinate Judge<\/p>\n<p>      rejected the Commission Report saying that the<\/p>\n<p>      Commissioner inspected the property four years<\/p>\n<p>      after the relevant date. We are in a position to<\/p>\n<p>      approve the action of the learned Subordinate<\/p>\n<p>      Judge in having discarded the Commission Report<\/p>\n<p>      and hold that the report cannot be relied on to<\/p>\n<p>      hold that the property under acquisition and the<\/p>\n<p>      property in Ext.A1 are similar. At the same time,<\/p>\n<p>      we notice that the property covered by Ext.A1 was<\/p>\n<p>      also acquired by the Government for the very<\/p>\n<p>      same purpose. We gather that the above,<\/p>\n<p>      property was treated as reclaimed land and a<\/p>\n<p>      higher rate was granted. Even though Ext.A1<\/p>\n<p>      pertains a different type of land, we feel that the<\/p>\n<p>      market value for reclaimed lands reflected in<\/p>\n<p>L. A. A. No.1510 of 2009 &amp; con. cases -4-<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>      Ext.A1 has some bearing on the correct market<\/p>\n<p>      value of wet lands. Keeping the above aspect in<\/p>\n<p>      mind and making a re-assessment of the entire<\/p>\n<p>      evidence ignoring the oral evidence adduced by<\/p>\n<p>      the parties and Ext.C1 report, we are of the view<\/p>\n<p>      that the market value of the land under<\/p>\n<p>      acquisition      can      be    reasonably  re-fixed at<\/p>\n<p>      Rs.2,525\/- per Are. Accordingly, we re-fix the<\/p>\n<p>      market value of the land under acquisition at<\/p>\n<p>      Rs.2,525\/- per Are. This means that for the land<\/p>\n<p>      under      acquisition,      the   appellants  will get<\/p>\n<p>      Rs.1,001\/- per Are more than what is awarded to<\/p>\n<p>      them by the Land Acquisition Court. The appeal<\/p>\n<p>      will stand allowed as above. The appellants will be<\/p>\n<p>      entitled for all statutory benefits admissible under<\/p>\n<p>      Sections 23(2), 23(1A) and under Section 28 of<\/p>\n<p>L. A. A. No.1510 of 2009 &amp; con. cases -5-<\/p>\n<blockquote><p>      the Land Acquisition Act. While drafting the<\/p>\n<p>      decree, the Section will have due regard to the<\/p>\n<p>      conditions imposed by this Court in the orders<\/p>\n<p>      condoning the delay caused in the matter of fling<\/p>\n<p>      the appeals. Parties are directed to suffer their<\/p>\n<p>      respective costs. Registry will issue certified<\/p>\n<p>      copies of the decree to the appellants only after<\/p>\n<p>      ensuring that full court fee is remitted.<\/p>\n<\/blockquote>\n<blockquote><p>                                           PIUS C.
