RAMACHANDRA MENON, J.\n          .......................................................................\n                      WP (C) NO. 9051 OF 2010\n                   ...............................................\n           Dated this the 18th day of March, 2010\n\n\n                               J U D G M E N T\n<\/pre>\n<p>                              &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>     Challenging Exhibit P1 order imposing penalty and<\/p>\n<p>Exhibit P2 order of assessment, the petitioner has filed<\/p>\n<p>Exhibit P3 and P4 appeals before the Statutory\/Appellate<\/p>\n<p>Authority, along with Exhibit P5 and Exhibit P6 petitions for<\/p>\n<p>stay. After considering the merits of the case, the Appellate<\/p>\n<p>Authority passed Exhibit P7 common order,                                  directing the<\/p>\n<p>petitioner to pay 50% of the amount due and to furnish<\/p>\n<p>security for the balance amount, to the satisfaction of the<\/p>\n<p>Assessing Authority, which in turn forms the subject matter<\/p>\n<p>of challenge in this writ petition. It is stated that there is<\/p>\n<p>no rationale for imposing the condition in Exhibit P7, to<\/p>\n<p>such an extent.\n<\/p>\n<p>     2. Learned Government Pleader submits, referring to<\/p>\n<p>the materials on record that,                       there was an inspection<\/p>\n<p>WP (C) NO. 9051 OF 2010<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>whereupon large scale evasion\/suppression was detected<\/p>\n<p>and it was in the said circumstances, that the matter was<\/p>\n<p>considered and the assessing authority imposed the penalty<\/p>\n<p>to the extent as specified. It is also stated by the learned<\/p>\n<p>Government Pleader that the relevant facts and figures<\/p>\n<p>have been considered meticulously by the authorities, while<\/p>\n<p>passing the impugned orders and hence that there is no<\/p>\n<p>merit or bonafides with regard to the challenge raised in<\/p>\n<p>the appeals filed before the third respondent.<\/p>\n<p>       3. The grievance of the petitioner is rather with regard<\/p>\n<p>to the sustainability of the condition imposed. Taking note<\/p>\n<p>of, the quantum of penalty imposed as per Exhibit P1 and<\/p>\n<p>the balance tax and interest due to be recovered vide<\/p>\n<p>Exhibit P2 assessment order, 50% of the said liability now<\/p>\n<p>ordered to be satisfied to avail the benefit of interim stay<\/p>\n<p>cannot be said as arbitrary or unreasonable. More so, when<\/p>\n<p>the course and events have been specifically dealt with by<\/p>\n<p>WP (C) NO. 9051 OF 2010<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>the authorities who passed Exhibit P1 and P2. The only<\/p>\n<p>question to be considered is whether the order imposing the<\/p>\n<p>condition has been passed in quite a mechanical or stereo<\/p>\n<p>typed manner.           Going by    Exhibit P7 it is very much<\/p>\n<p>discernible that the third respondent\/appellate authority<\/p>\n<p>has referred to the actual facts and circumstances revealed<\/p>\n<p>from the materials on record. It is also observed therein<\/p>\n<p>that, on going through the grounds of appeal, prima facie it<\/p>\n<p>appeared that the appellant had no proper explanation for<\/p>\n<p>the stock variation.        It is after considering the relevant<\/p>\n<p>aspects as above, that the condition was imposed, directing<\/p>\n<p>the petitioner to satisfy 50% of the disputed liability. This<\/p>\n<p>being the position, it cannot be said that Exhibit P7 interim<\/p>\n<p>order passed by the third respondent is not a &#8216;speaking one&#8217;<\/p>\n<p>or that it is without proper application of mind.           The<\/p>\n<p>challenge raised by the petitioner is not sustainable. The<\/p>\n<p>writ petition fails and the same is dismissed accordingly.<\/p>\n<p>WP (C) NO. 9051 OF 2010<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>However, taking of the fact that the time stipulated in<\/p>\n<p>Exhibit P7 to satisfy the condition stands already expired,<\/p>\n<p>the petitioner is granted a further period of two weeks from<\/p>\n<p>the date of receipt of a copy of this judgment, so as to<\/p>\n<p>satisfy the condition and avail the benefit of interim stay<\/p>\n<p>during the pendency of the appeal.\n<\/p>\n<\/p>\n<p>                                           Sd\/-\n<\/p>\n<p>                             P.R.
