Respondents\n                                -----------\n<\/pre>\n<p>2.   14.7.2011           This writ application involves the<\/p>\n<p>               basic     issue          as     with    regard       to        either<\/p>\n<p>               selection       or       continuance         on    the    post    of<\/p>\n<p>               Shiksha Mitra. Though the post of Shiksha<\/p>\n<p>               Mitra came to be abolished in the year 2006,<\/p>\n<p>               the petitioner has a grievance that had he<\/p>\n<p>               been    selected\/             continued      on    the    post     of<\/p>\n<p>               Shiksha Mitra he could have been absorbed as<\/p>\n<p>               a     Panchayat          Shikshak       in        view    of     the<\/p>\n<p>               provisions made under 2006 Act laying down<\/p>\n<p>               the     norms     of      selection          on   the     post    of<\/p>\n<p>               Panchayat Shikshak\/ Prakhand Shikshak.<\/p>\n<pre>                           As       a    matter        of    fact       for     such\n\n               grievance       some       of    the    similarly         situated\n\n               persons     had        moved      the     District        Teachers\n\n               Appellate       Authority         constituted        under       2006\n<span class=\"hidden_text\">                               2<\/span>\n\n\n\n\n<\/pre>\n<p>            Act but then the concerned &#8216;Authority&#8217; had<\/p>\n<p>            taken a view its jurisdiction was confined<\/p>\n<p>            to dealing only with the cases of Panchayat<\/p>\n<p>            Shikshak\/ Prakhand Shikshak. This aspect of<\/p>\n<p>            the      matter       had     accordingly         received<\/p>\n<p>            attention of the State Government which by<\/p>\n<p>            way    of    clarification    in   its      letter    dated<\/p>\n<p>            14.5.2009 has held that even the disputes<\/p>\n<p>            relating to the post of Shiksha Mitra could<\/p>\n<p>            be     adjudicated     by    the   District      Teachers<\/p>\n<p>            Appellate Authority.\n<\/p>\n<p>                          Counsel for the petitioner in view<\/p>\n<p>            of     the    aforesaid      subsequent        development<\/p>\n<p>            seeks leave of this Court to withdraw his<\/p>\n<p>            writ    application     in    order    to      enable   the<\/p>\n<p>            petitioner      to    move    before     the    concerned<\/p>\n<p>            District Teachers Appellate Authority.<\/p>\n<p>                         That being so, this application is<\/p>\n<p>            permitted       to     be     withdrawn        with     the<\/p>\n<p>            aforementioned liberty.\n<\/p>\n<\/p>\n<p>                                           (Mihir Kumar Jha,J.)<\/p>\n<p>Surendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramdeo Das vs The State Of Bihar &amp; Ors on 14 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.8489 of 2007 Ramdeo Das, Son of Sri Bhudeo Das, resident of village Faga, P.S.
