DENESAN, J.\n\n\n\n                    = = = = = = = = = = = = = = =\n\n                        W.P.(C) No. 4373 OF 2007 U\n\n                    = = = = = = = = = = = = = = =\n\n\n\n                  Dated this the 26th February, 2007\n\n\n\n                                J U D G M E N T\n<\/pre>\n<p>     The   petitioners   are   working   as   II   Grade   Overseers<\/p>\n<p>in   the   Kerala   Land   Development   Corporation-the   2nd<\/p>\n<p>respondent.     The   request   made   by   the   petitioners   for<\/p>\n<p>equalising   their  pay  by  enhancing  the  same  to  Rs.4000-\n<\/p>\n<p>6090 has been rejected by the Government as per Ext. P6<\/p>\n<p>letter   dated   31-8-2006.     Overseers   Grade   II   of   the<\/p>\n<p>Public   Works   Department,   Irrigation   and   Harbour<\/p>\n<p>Engineering   Department   under   the   Government   have   been<\/p>\n<p>sanctioned   the   enhanced   pay   scale   of   Rs.4000-6090   as<\/p>\n<p>per   Ext.   P5   order   dated   8-6-2001.     According   to   the<\/p>\n<p>petitioners,            they         are         entitled         for         a         similar<\/p>\n<p>enhancement.     The   grievance   of   the   petitioners   was<\/p>\n<p>taken up by the 3rd  respondent-Managing Director of the<\/p>\n<p>2nd respondent-Corporation with the Government.  But the<\/p>\n<p>Government   replied   that   the   benefit   granted   to<\/p>\n<p>Overseers   Grade  II  in  the  Government  Department  as  per<\/p>\n<p>Ext. P5 have not been extended to Overseer Grade II or<\/p>\n<p>Draftsman         Grade         II          working         in         the         statutory<\/p>\n<p>corporations   or   local   bodies   or   any   other   Government<\/p>\n<p>departments.\n<\/p>\n<p><span class=\"hidden_text\">WPC No.4373 \/2007                 -2-<\/span><\/p>\n<p>        2. The pay scale determined for various categories<\/p>\n<p>in   Government   departments   are   not   automatically<\/p>\n<p>sanctioned   to   similar   categories   of   employees   in<\/p>\n<p>Government Corporations and companies.  Whether the pay<\/p>\n<p>scale   shall   be   equalised   or   enhanced   is   a   matter   of<\/p>\n<p>policy.  Hence, a writ of mandamus sought for directing<\/p>\n<p>the   Government   to   sanction   a   similar   pay   scale   to   the<\/p>\n<p>petitioners   who   are   working   in   a   statutory   Corporation<\/p>\n<p>cannot   be   issued.     Since   the   Government   have   stated<\/p>\n<p>that   the   pay   scale   of   similar   categories   of   employees<\/p>\n<p>in   the   Corporations   and   Government   companies   have   not<\/p>\n<p>been enhanced, the petitioners are at liberty to make a<\/p>\n<p>fresh   claim   for   sanctioning   them   also   similar   pay<\/p>\n<p>scales   in   tune   with   any   decision   taken   by   the<\/p>\n<p>Government   to   enhance   the   pay   scales   of   similar<\/p>\n<p>categories   of   employees   in   any   of   the   Corporations   or<\/p>\n<p>Government   companies.           Without   prejudice   to   that<\/p>\n<p>freedom, this writ petition is dismissed.\n<\/p>\n<p>                                                   K.K.
