The affidavits filed by the<br \/>\nMamlatdar and the Assistant Geologist are also taken into<br \/>\nconsideration.\n<\/p>\n<p>\tOn<br \/>\ninstructions from the office of the Assistant Geologist whose officer<br \/>\nMr. R.S.Kalariya is present, learned GP, Mr. Jani has stated that the<br \/>\nland in question has not been allotted either to the petitioner or to<br \/>\nthe said other person &#8211; applicant &#8211; Mr. Nimbark and any lease<br \/>\norder or permit has not been issued in favour of the petitioner or<br \/>\nthe other person &#8211; applicant &#8211; Mr. Nimbark. He has also stated that<br \/>\nthe application of the said other person &#8211; applicant &#8211; Mr.<br \/>\nNimbark is also declined in view of the opinion declaring that there<br \/>\nis overlapping. The said declaration is taken note of, however, the<br \/>\noffice of the Assistant Geologist will file affidavit to this<br \/>\neffect.\n<\/p>\n<p>\tIn<br \/>\nview of the affidavit made by Mr. Kalariya, Assistant Geologist, it<br \/>\nappears that the actions taken by him were taken under oral<br \/>\ninstructions from the Collector. Therefore, it is directed that the<br \/>\nconcerned Collector will file affidavit with regard to the averments<br \/>\nmade by said Mr. Kalariya in his affidavit dated 24.3.2011 and also<br \/>\nin his earlier affidavit dated 11.3.2011 and the concerned Collector<br \/>\nwill clarify the factual aspects stated by the Assistant Geologist<br \/>\nand he shall also confirm or deny the statements made by the<br \/>\nAssistant Geologist about the oral instructions said to have been<br \/>\ngiven by the Collector.\n<\/p>\n<p>\tIn<br \/>\nview of the fact that there appears to be some overlapping, as per<br \/>\nthe opinion from the office of the Mamlatdar, it may, at later stage,<br \/>\nbe necessary to direct the petitioner to implead the said 3rd<br \/>\nparty. In the meanwhile, it would be open to the petitioner to<br \/>\nconsider as to whether the petitioner on its own would consider it<br \/>\nnecessary to implead the said 3rd party or not.
