No.27651 of 2010\n                 RINKU SINGH, Son of Sri Dwarika Singh, resident of\n                 Villlage-Mohanpur Karja, Police Station Barhara in the\n                 district of Bhojpur.\n                                                  Versus\n                                          STATE OF BIHAR .\n                                                -----------\n<\/pre>\n<p>3   12.10.2010                 Having heard Mr. Akhileshwar Prasad Singh, learned<\/p>\n<p>                   senior counsel appearing on behalf of the petitioner, counsel for<\/p>\n<p>                   the State as also counsel for the Informant, while this Court<\/p>\n<p>                   considering seriousness of the allegation for offence u\/s 364 I.P.C.<\/p>\n<p>                   as brought forward by the informant of the petitioner being last in<\/p>\n<p>                   the company of the deceased and its being also corroborated in the<\/p>\n<p>                   three statements under section 164 of the Code of Criminal<\/p>\n<p>                   Procedure, this Court is not inclined to grant bail to the petitioner<\/p>\n<p>                   for the present. Accordingly, prayer for bail of the petitioner is<\/p>\n<p>                   rejected for the present.\n<\/p>\n<p>                               The petitioner is in custody since 5.6.2010. Counsel<\/p>\n<p>                   for the Informant would submit that the Informant will produce all<\/p>\n<p>                   the named private witnesses in the chargesheet within a period of<\/p>\n<p>                   six months from the date of framing of charge. The Superintendent<\/p>\n<p>                   of Police, Bhojpur is also directed to ensure production of the<\/p>\n<p>                   official witnesses including the Investigating Officer within the<\/p>\n<p>                   same period of six months.\n<\/p>\n<p>                               Since the petitioner is in custody and is the sole<\/p>\n<p>                   accused, there should not be also any difficulty in either<\/p>\n<p>                   committing the case or framing the charge. The trial court,<\/p>\n<p>                   therefore, should take all expeditious steps to conclude trial of the<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>              petitioner as expeditiously as possible preferably within a period<\/p>\n<p>              of nine months from the date of receipt\/production of copy of this<\/p>\n<p>              order.\n<\/p>\n<p>                          If the trial of the petitioner is not concluded within the<\/p>\n<p>              aforementioned period, the petitioner will have liberty initially to<\/p>\n<p>              move the trial court which then would record its reason for not<\/p>\n<p>              concluding the trial, whereafter the petitioner may renew his<\/p>\n<p>              prayer for bail before this Court.\n<\/p>\n<\/p>\n<pre>Abhay Kumar                                         ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rinku Singh vs State Of Bihar on 12 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
