The<br \/>\nrespondent was served with a show cause notice for his negligence<br \/>\nbehaviour. After due procedure his service  came to be terminated on<br \/>\n13th May 1987. The respondent raised a dispute which<br \/>\nculminated in Reference  LCA No.1716 of 1987. According to the<br \/>\npetitioner the notice issued by the Labour Court was misplaced and<br \/>\ncould not remain present before the Court. In the meantime the<br \/>\ncompany was closed in the year 1993.An exparte award came to be filed<br \/>\non 14th October 1996. On coming to know about the same the<br \/>\npetitioner filed Misc. Application  No.214 of 1997 along with an<br \/>\napplication praying for condonation of delay below Exh.4. The said<br \/>\napplication came to be rejected against which the present petition is<br \/>\nfiled.\n<\/p>\n<p>3.\tThe<br \/>\ndelay was only 39 days and the petitioner has explained the delay. If<br \/>\nthe delay is condoned at the most that can happen is hearing the<br \/>\nmatter on merits. Therefore in the ordinary course after condoning<br \/>\nthe delay the matter could have been remanded. However, it is stated<br \/>\nthat  the respondent workman has died on 5th August 2005<br \/>\nand the petitioner company is already closed. In that view of the<br \/>\nmatter no useful purpose would be served by remanding the matter.\n<\/p>\n<p>4.\tTherefore<br \/>\nthe impugned order dated 27th March 2000 is quashed and<br \/>\nset aside and the  Misc. Application No.214 of 1997 is allowed and<br \/>\nwith the consent of the parties learned advocates are heard on the<br \/>\nmerits of the judgement and award of the Labour Court.\n<\/p>\n<p>5.\tSince<br \/>\nthe respondent workman has already died, now there is no question of<br \/>\nreinstatement. Therefore interest of justice would be met by passing<br \/>\nthe following order:\n<\/p>\n<p>&#8220;The<br \/>\nrespondent workman is deemed to have been continued in service till<br \/>\nhe died on 5th August 2005 and therefore he shall be paid<br \/>\nhis salary from 1st November 1996 to 5th August<br \/>\n2005.
