Justice K.T.SANKARAN\n\n Dated :23\/03\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.934 of 2010\n                  ---------------------------------------------\n             Dated this the 23rd day of March, 2010\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioner is the sole<\/p>\n<p>accused in Crime No.572 of 2009 of Harippad Police Station.<\/p>\n<p>     2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 468, 471 and 409 of the Indian Penal Code.<\/p>\n<p>     3.   When the Bail Application came up for hearing on<\/p>\n<p>10.3.2010, the following order was passed:<\/p>\n<blockquote><p>                 &#8220;After having heard the learned counsel for<\/p>\n<p>          the petitioner and the learned Public Prosecutor, I<\/p>\n<p>          am of the view that before disposing of the Bail<\/p>\n<p>          Application, an opportunity should be given to the<\/p>\n<p>          petitioner to appear before the investigating<\/p>\n<p>          officer. Accordingly, there will be a direction to<\/p>\n<p>          the petitioner to appear before the investigating<\/p>\n<p>          officer at 9 A.M. on 16th and 17th March 2010.<\/p>\n<\/blockquote>\n<blockquote><p>                Post on 23.3.2010.\n<\/p><\/blockquote>\n<blockquote><p>                It is submitted by the learned Public<\/p>\n<p>           Prosecutor that the petitioner will not be arrested<\/p>\n<p>           until further orders in connection with Crime<\/p>\n<p>           No.572 of 2009 of Harippad Police Station,<\/p>\n<p><span class=\"hidden_text\">BA No.934\/2010                    2<\/span><\/p>\n<p>            Alappuzha District.\n<\/p><\/blockquote>\n<blockquote><p>                 The petitioner shall produce copy of this<\/p>\n<p>            order before the investigating officer.&#8221;<\/p><\/blockquote>\n<p>      4.    It is submitted by the learned counsel for the<\/p>\n<p>petitioner as well as the learned Public Prosecutor that the<\/p>\n<p>direction contained in the order dated 10.3.2010 has been<\/p>\n<p>complied with by the petitioner.\n<\/p>\n<p>      5.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and also taking note of the fact<\/p>\n<p>that the direction in the order dated 10.3.2010 has been<\/p>\n<p>complied with by the petitioner,         I am of the view that<\/p>\n<p>anticipatory bail can be granted to the petitioner.<\/p>\n<p>      There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioner, the officer in charge of the police station shall<\/p>\n<p>release him on bail on his executing bond for Rs.15,000\/- with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<p>a)    The petitioner shall appear before the investigating officer<br \/>\n      for interrogation as and when required;<\/p>\n<p>b)    The petitioner shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;<\/p>\n<p><span class=\"hidden_text\">BA No.934\/2010                    3<\/span><\/p>\n<p>c)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>d)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed to the extent indicated<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sasi Kumar vs State Of Kerala on 23 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 934 of 2010() 1.
