heads  against the claim of appellant for<\/p>\n

A  felt necessitated to present this appeal on the<\/p>\n
grpund that the arnount awarded by the Claims<\/p>\n
 Tribunal is inadequate and he is entitled for<\/p>\n

2. The appellant claims that he was aged about<\/p>\n
48 years at the time of accident and he is a x7_ege;t.ab.le\u00e9<\/p>\n
vendor and he is the sole bread winner in the .<\/p>\n
that as ii: may. That on 30.3.2002  <\/p>\n
when he was walking on the 1eft:ipsidj_eA~of the <\/p>\n
HMT Ground, R.T.Nagara lVi3ai:n~…Road’;  that ” it<\/p>\n
time, the rider of. the..n”1ot.or.c},rcie   04 Y
\n4573 driven in a rash  dashed
\nagainst the appellant,  appellant fell
\ndown and   left lower limb
\n illetfteeelelg below the knee and
\nsu_stai_n”ed_”  Having regard to the<\/p>\n
nature of injuries 7,sustained in the accident, the<\/p>\n
  \ufb01led  petition against. the respondents<\/p>\n
p_’ciain1i_rig:_:’c.on%iper1sation of Rs.l0,00.000\/~. The said<\/p>\n
 petitioniilhad come up before the Claims Tribunal<\/p>\n
‘\\_for cronsideration on 18.8.2005. The Claims Tribunal,<\/p>\n
V.’–V’i_Etf.t_(3I’t:’C21l’f3fl,1l evaluation of the oral and documentary<\/p>\n
 evidence and other relevant material on record has<\/p>\n
 allowed the claim petition in part. and awarded<\/p>\n
compensation of Rs. 1.4\u00bb ,O40\/– with interest’. at 6% from<\/p>\n
i<\/p>\n
the date of petition till the date of deposit. Being<\/p>\n
aggrieved by the same. the appellant has presen.ted.<_:lth_e<\/p>\n
irrist-ant appeai. claiming enhancement of Co_rn__pe':1satio\u00a7n__C' .<\/p>\n

3. As against this, learned-.VCounsel’  second
\nrespondent —  alia. contends

\ncorisiderlatioii C   of injuries sustained.<\/p>\n

5. After careful consideration of the submission
\nmade by the learned Counsel for both parties,
\npoint that arises for our consideration is: I l V<\/p>\n
“Whether the Compensation   \u00ab _<\/p>\n
the Tribunal is just and rea:sonable?’l”‘es.. 1   l<\/p>\n
6. After critical evaluatiorrof
\nand after perusal of  juid”gn:i:e~nlt'”s..g;1nd award, what
\nemerges is that the ap1:\u00a7e1lla13l{:V-ylvas 48 years<\/p>\n
at the time of\u00a7.vaCei:jdent;  He<\/p>\n
sustained  lower limb and<\/p>\n
ui1de1″g:orie llsuystained pennarient disability<\/p>\n
‘which   8.00\/5 to. the lovirer limb. and<\/p>\n
_ 300\/gto utl1elv’vh._ole body. As per Schedule I of the<\/p>\n
 \\:’N’o.rll\u00a71nenfsfiompensation Act, having regard to the<\/p>\n
 l<Vj'i':ari_1.f1_.i._uli.f;"i'els, the disability should be taken at 50%<\/p>\n
V . to  tyholle body. He has undergone treatment: for<\/p>\n
it than one month during which he has suffered<\/p>\n
"and agony. These aspects have not been<\/p>\n
 "Considered nor looked into by the Claims 'l'ribLmal.<\/p>\n
Therefore. having regard to the nature of injuries<\/p>\n
sustained, nature and duration of treatment and pain<\/p>\n

\n\u00a3<\/p>\n
and suffering. we deem it proper to award Rs.1.00 lakh
\ntowards 'pain and sufferings' as against a<\/p>\n
awarded by the Claims Tribunal.\n<\/p>\n
7. The Claims Tribunal has” awarlded\ufb01awlv<\/p>\n
Rs.i2,000\/- towards ‘medical  The<\/p>\n
just and reasonable and doesnotseall for lim.erfe’1fenee.<\/p>\n
8. The Claims V’f’\u00ab-ribunai   awarding only
\nRs.8,000\/~ towards ‘(;.o’11Ve:yar1c&e\u00bb,_  food and
\nattendant  the same isiinadequate for the
\nreason vi’t1h’at._tf:e  haswtnldergone treatment. for
\nmore  one has suffered amputation of<\/p>\n
left leg bleiow’  might have spent some<\/p>\n

  charges. This aspect has not been<\/p>\n
coiisideifedltxoi’ looked into by the Claims Tribtlnal.<\/p>\n

A  “-nat1_.1r::: of injuries, we deem it fit to award a sum of<\/p>\n
 _.Rs.20.000\/– towards ‘Conveyance. no1,1r1’s}’1ing food and<\/p>\n
 attendant charges’ as against Rs.8,000\/– awarded by<\/p>\n
the Claims Tribunal. %)

9. The Claims Tribunal erred in awarding only<\/p>\n
Rs.?’,2OO\/M towards ‘loss of income during laidvsup<\/p>\n
period’. Having regard to the avocation of i:l1e’va;}pell4a;.it’,~\u00ab 3<\/p>\n
we reassess the income of the appellant  p  <\/p>\n

  ..agony and undergone surgery for amputation. Taking<\/p>\n
V these relevant aspects \/\/ti)\/pensideration, Rs.50,OOO\/M<\/p>\n
is awarded towards ‘loss of amenities’ as against<\/p>\n
Rs.20,000\/~ awarded by the Claims ‘”l’ribunal.<\/p>\n
11. Further, the Claims Tribunal<\/p>\n
