P (C) No. 32582 of 2009\n               =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                Dated this, the 13th November, 2009.\n\n                            J U D G M E N T\n<\/pre>\n<p>      Petitioners are the President and Secretary of the Chengallur<\/p>\n<p>Grama Vyavasaya Sahakarana Sangham Ltd., which is a society<\/p>\n<p>registered under the Kerala Co-operative Societies Act, and<\/p>\n<p>recognised by the Kerala Khadi and Village Industries Board. The<\/p>\n<p>Board has granted a loan to the society, repayment of which is in<\/p>\n<p>arrears. The Board initiated proceedings for recovery of the same.<\/p>\n<p>Ext. P1 notice has been issued to the President of the society with<\/p>\n<p>copies of the notice to the managing committee members also. The<\/p>\n<p>petitioners challenge the same on the ground that the same amounts<\/p>\n<p>to recovery personally from the managing committee members who<\/p>\n<p>are   not liable for repayment of the amounts.        According to the<\/p>\n<p>petitioners, the society has sufficient assets, which can be proceeded<\/p>\n<p>against for recovery of the amounts.\n<\/p>\n<p>      2. I have heard the standing counsel for the Board as well as<\/p>\n<p>the learned Government Pleader.\n<\/p>\n<p>      3.   First of all, I am not satisfied that Ext. P1 amounts to<\/p>\n<p>personal recovery against the members of the managing committee.<\/p>\n<p>Ext. P1 is a notice issued to the President of the Society with copies to<\/p>\n<p>the managing committee members directing payment of the amounts<\/p>\n<p>due. Secondly, the petitioners are the President and Secretary and<\/p>\n<p>not the individuals against whom personal recovery is apprehended.<\/p>\n<p>Even otherwise, the recovery pursuant to a contract between the<\/p>\n<p>parties, which does not involve any violation of the provisions of the<\/p>\n<p><span class=\"hidden_text\">W.P.C. No. 32582\/09               -: 2 :-<\/span><\/p>\n<p>Kerala Co-operative Societies Act and Rules, the remedy of the<\/p>\n<p>petitioners lie in filing an arbitration case under Section 69 of the<\/p>\n<p>Kerala Co-operative Societies Act before the appropriate authority.<\/p>\n<p>Without prejudice to that right, this writ petition is dismissed.<\/p>\n<p>                                          S.
