PUBLIC PROSECUTOR for\nRespondent(s) : 1 -\n3 \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\nDate\n: 02\/12\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>(Per : HONOURABLE<br \/>\nMR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\tRule.\n<\/p>\n<p> Mr. Dabhi, learned APP appears and waives service of notice of Rule<br \/>\non behalf of the respondents.\n<\/p>\n<p>2.\tBy<br \/>\nfiling instant petition under Article 226 of the Constitution of<br \/>\nIndia, the petitioner has prayed to issue writ of Habeas Corpus or<br \/>\nany other appropriate writ, direction and\/or order directing the<br \/>\nrespondent authorities to find out and produce the corpus namely<br \/>\nSmita &#8211; daughter of the petitioner before this Court.\n<\/p>\n<p>3.\tAs<br \/>\nper the averments made in the petition, on 9.11.2010, daughter of the<br \/>\npetitioner had not returned home from a computer class.  The<br \/>\npetitioner therefore, tried to search her everywhere.  On 10.11.2010,<br \/>\n the petitioner came to know that three persons namely (1) Mukeshbhai<br \/>\nUdesinh Parmar (ii) Bhupendrabhai Shankerbhai Chavda and (iii)<br \/>\nAlpeshbhai &#8211; Teacher have kidnapped the corpus Smita from her<br \/>\nGuardian&#8217;s custody and have taken away the corpus on Bike No.GJ 23 I<br \/>\n9492.  On 11.11.2010, the petitioner filed application before the<br \/>\nAnand Town Police Station, but not action has been taken.  The<br \/>\npetitioner therefore, approached the DSP on 14.11.2010, but no action<br \/>\nhas been initiated.  Therefore, on 15.11.2010, petitioner filed<br \/>\nCriminal Misc. Application for search of the farm house of the<br \/>\nprobable accused, but it was not considered by the Chief Judicial<br \/>\nMagistrate and the same has been disposed of as withdrawn.  The<br \/>\npetitioner has therefore, filed instant petition seeking writ of<br \/>\nHabeas Corpus and prayed for the relief to which the reference is<br \/>\nmade in the earlier paragraph of this judgment.\n<\/p>\n<p>4.\tThis<br \/>\nCourt vide order dated 23.11.2010 issued Notice to respondents, which<br \/>\nwas made returnable on 7.12.2010 on condition that the applicant<br \/>\nshall deposit Rs.10,000\/- as a cost, to show her bona fide, on or<br \/>\nbefore 26.11.2010 before the Registry of this Court.  In compliance<br \/>\nof the said order, the applicant has deposited Rs.10,000\/- and<br \/>\nthereafter, the Notice came to be issued to the respondents.\n<\/p>\n<p>5.\tToday<br \/>\nwhen the matter is called out, Mr. LB Dabhi, learned APP for the<br \/>\nrespondents, upon instructions received from Mr. RS Vaghela, PSI,<br \/>\nAnand Police Station who is personally present in the Court, states<br \/>\nthat corpus Smita was in the company of Mukeshbhai Udesinh Parmar and<br \/>\nshe has been found out from his house at Isanpur, Ahmedabad and<br \/>\ntherefore, he wants to produce the corpus before the Court in<br \/>\ncompliance of the direction issued by this Court.  We have therefore,<br \/>\npermitted him to produce the corpus before us.\n<\/p>\n<p>6.<br \/>\n We have ascertained the wish and willingness of corpus Smita and<br \/>\ninquired as to whether she was in illegal detention of Mukeshbhai<br \/>\nUdesinh Parmar.  She has unequivocally stated before us that she is<br \/>\naged about 22 years and studied upto B.A. (Arts) and when she was<br \/>\nstaying with her maternal uncle&#8217;s house at Bhalej &#8211; Kasod,<br \/>\nAnand and was prosecuting her further study in computer centre, she<br \/>\ncame in contact with Mukeshbhai Udesinh Parmar.  She therefore, went<br \/>\nwith him and came to Ahmedabad.  She has further stated that at her<br \/>\nown will, she has accompanied  Mukeshbhai Udesinh Parmar and she was<br \/>\nnot in illegal detention of Mukeshbhai<br \/>\nUdesinh Parmar.  She has also stated that now, she has decided to go<br \/>\nat her parental house with the petitioner, who is personally present<br \/>\nbefore the Court along with his wife, where she can think over<br \/>\nabout her future.  Since corpus Smita is aged about 22 years, she is<br \/>\nsui juris and hence, no fetters can be placed upon her choice of the<br \/>\nperson with whom she has to stay.  We have therefore, permitted her<br \/>\nto go at her parental house with<br \/>\nthe petitioner, who is personally present before the Court along<br \/>\nwith his wife<\/p>\n<p>7.\tSeen<br \/>\nin the above context, there is substance in the Habeas Corpus<br \/>\npetition and the same deserves to be allowed.\n<\/p>\n<p>8.\tFor<br \/>\nthe foregoing reasons, the petition succeeds and it is accordingly<br \/>\nallowed.  Rule is made absolute.\n<\/p>\n<p>9.\tThe<br \/>\ncorpus Smitaben is permitted to go<br \/>\nat her parental house with the petitioner, who is personally present<br \/>\nbefore the Court along with his wife.\n<\/p>\n<p>10.\tAt<br \/>\nthe time of issuance of Notice, this Court directed the petitioner to<br \/>\ndeposit Rs.10,000\/- as a cost, to show his bona fide, before the<br \/>\nRegistry of this Court.
