PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder sec. 439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 326, 294(B)<br \/>\nof IPC and sec. 135(1) of the Bombay Police Act for which FIR, being<br \/>\nC.R. No. I-183\/2010, has been registered with Ishanpur Police<br \/>\nStation.\n<\/p>\n<p>3.\tLearned advocate Mr.<br \/>\nRaval referred to the FIR and submitted that the victim has been<br \/>\ndischarged from the hospital and the incident occurred all of a<br \/>\nsudden and therefore the present application may be allowed.\n<\/p>\n<p>4.\tLearned APP Mr.<br \/>\nShukla resisted the application, though he confirmed that the victim<br \/>\nis discharged from the hospital and is out of danger and the knife<br \/>\nhas been recovered.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Raval and learned APP Mr. Shukla and<br \/>\nhaving perused   the papers and considering the nature of offence and<br \/>\nthe role attributed and also considering the guidelines with regard<br \/>\nto grant of bail, the present application deserves to be allowed.\n<\/p>\n<p>6.\tThe application is<br \/>\naccordingly allowed.  The applicant-accused CHOWLA<br \/>\nRAM UKAJI PRAJAPATI is ordered to be released on<br \/>\nbail in connection with C.R. No. I-183\/2010  registered with<br \/>\nIshanpur Police Station,  on his executing a personal bond of Rs.<br \/>\n5,000\/- (Rupees Five Thousand only) with one solvent surety for the<br \/>\nlike amount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the charge sheet is<br \/>\nfiled.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
