No.19700 of 2010\n                              SANTOSH KUMAR GUPTA\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>04   27.10.2010               Heard learned counsel for the petitioner as well as<\/p>\n<p>                  learned counsel appearing for the informant.<\/p>\n<p>                              Petitioner is husband and there is allegation against<\/p>\n<p>                  him that he along with his other family members demanded rupees<\/p>\n<p>                  five lacs to start a business and when the aforesaid demand was<\/p>\n<p>                  not fulfilled, he as well as his other family members started<\/p>\n<p>                  torturing the informant in both ways mentally and physically.<\/p>\n<p>                              It would appear from the record that at the instance of<\/p>\n<p>                  the petitioner a notice was issued to the informant for<\/p>\n<p>                  reconciliation but today the learned counsel for the petitioner<\/p>\n<p>                  submitted that the petitioner is not ready to keep the informant<\/p>\n<p>                  with him.\n<\/p>\n<p>                              On the other hand learned counsel for the informant<\/p>\n<p>                  submitted that the informant is still ready to lead her conjugal life<\/p>\n<p>                  with the petitioner.\n<\/p>\n<p>                              Although prior to the lodging of the instant case, the<\/p>\n<p>                  petitioner had filed a divorce case against the informant but in my<\/p>\n<p>                  view the aforesaid fact is not sufficient to give the benefit of<\/p>\n<p>                  privilege of anticipatory bail to the petitioner, particularly, keeping<\/p>\n<p>                  in mind the allegation levelled against the petitioner.<\/p>\n<p>                              In the aforesaid circumstances, this anticipatory bail<\/p>\n<p>                  stands rejected.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>                             However, the petitioner is directed to surrender before<\/p>\n<p>                 the Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S.Case no.<\/p>\n<p>                 121 of 2009 within 30 days from the date of communication of<\/p>\n<p>                 this order and seek regular bail.\n<\/p>\n<p>                             It is made clear that if the petitioner surrenders and<\/p>\n<p>                 seeks regular bail before the court below, the learned court below<\/p>\n<p>                 shall consider the aforesaid regular bail application on its own<\/p>\n<p>                 merit, particularly, keeping in mind that prior to filing of the<\/p>\n<p>                 instant criminal case, the petitioner had already filed a divorce suit<\/p>\n<p>                 against the informant and also explore the possibility of<\/p>\n<p>                 reconciliation.\n<\/p>\n<p>\nShahid\/Shahzad                               (Hemant Kumar Srivastava, J.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Santosh Kumar Gupta vs State Of Bihar on 27 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
