SECRETARY, PERSONNEL AND\n                    ADMINISTRATIVE REFORMS DEPARTMENT, GOVT.\n                    OF BIHAR, PATNA.\n                                       -----------\n<\/pre>\n<p>7   09\/11\/2010             Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                           Learned counsel for the petitioner submits that<\/p>\n<p>                   the petitioner   ought to have been given time bound<\/p>\n<p>                   promotion by calculating the period he had worked in the<\/p>\n<p>                   work charge establishment. He does not dispute that the<\/p>\n<p>                   petitioner was not entitled to any benefit while he was in<\/p>\n<p>                   the work charge establishment.     Once he came to be<\/p>\n<p>                   appointed in the regular establishment, in terms of<\/p>\n<p>                   Circular dated 27.03.1987 issued by the Finance<\/p>\n<p>                   Department, this period will have to be considered while<\/p>\n<p>                   granting time bound promotion.\n<\/p>\n<p><span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>                Without expressing any opinion on this aspect of<\/p>\n<p>        the matter, let petitioner file his claim with a Xerox copy<\/p>\n<p>        of the aforesaid circular along with a copy of this order<\/p>\n<p>        before the competent authority who shall examine<\/p>\n<p>        whether the claim of the petitioner in light of the said<\/p>\n<p>        circular makes out a case for grant of relief which he is<\/p>\n<p>        looking for which is grant of time bound promotion by<\/p>\n<p>        calculating the period he worked in the work charge<\/p>\n<p>        establishment.\n<\/p>\n<p>                This writ application is disposed of with a<\/p>\n<p>        direction that if petitioner moves before the competent<\/p>\n<p>        authority, a decision will be taken and communicated to<\/p>\n<p>        the petitioner by him in the matter within a period of four<\/p>\n<p>        months from the date of filing such claim.<\/p>\n<pre>AMIN\/                    (Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ali Ahmad vs State Of Bihar &amp;Amp; Ors on 9 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.8857 of 1996 ALI AHMAD SON OF MUMTAZ AHMAD RESIDENT OF RAJA BAZAR, P.S.
