Singh, Counsel for the respondents.<\/pre>\n<p>      A preliminary objection has been raised by the<br \/>\npetitioner that against the impugned order Annexure P-13 an<br \/>\nappeal is provided under Section 18(1) of NCTE Act, 1993.<br \/>\nAs an alternative efficacious remedy of filing statutory appeal<br \/>\nis available to the petitioner, this petition may not be<br \/>\nentertained.\n<\/p>\n<p>      In reply to this Shri Dixit, learned counsel for the<br \/>\npetitioner submitted that the facts of this case are peculiar.<br \/>\nBy order Annexure P-13 dated 25\/29.8.2008 the case of the<br \/>\npetitioner was turned down as per the decision of the 105th<br \/>\nWRC meeting of the respondent but in 106th meeting of WRC<br \/>\nAnnexure P-15, permission was accorded. The reason which<br \/>\nhas been shown in Annexure P-13 that the size of the class-<br \/>\nroom was smaller than the size prescribed by NCTE<br \/>\nconcerned but in this regard a subsequent letter dated<br \/>\n11.3.2008 has not been considered by the respondents.\n<\/p>\n<p>      Shri Singh, learned counsel for the respondents<br \/>\nsubmitted that there was some mistake in 106th meeting of<br \/>\nWRC in respect of which the respondents have explained in<br \/>\nthe additional return in which it is stated that in the remark<br \/>\ncolumn of &#8220;Decision of WRC&#8221;, the remark of some other<br \/>\ninstitution has wrongly been typed in the column against the<br \/>\npetitioner.\n<\/p>\n<p>       As an alternative remedy is available to the petitioner<br \/>\nto file statutory appeal against the impugned order, we are<br \/>\ninclined to entertain this petitioner and permit the petitioner\n<\/p>\n<p>                                                             2&#8230;..\n<\/p>\n<p>                     W.P.13475 of 2009<\/p>\n<p>15.9.2010<\/p>\n<p>to file appeal against the impugned order Annexure P-13<br \/>\nwithin a period of 30 days from today. The petitioner while<br \/>\nfiling the appeal shall be entitled to raise all the grounds<br \/>\nwhich are raised in this petition including the ground on the<br \/>\nbasis of decision of respondents in its 106th meeting Annexure<br \/>\nP-14.     The petitioner may also canvass to the Appellate<br \/>\nAuthority in respect of the letter dated 11.3.2008, stated to<br \/>\nbe sent to the respondents. The Appellate Authority on filing<br \/>\nsuch an appeal shall consider all the contentions of the<br \/>\npetitioner and shall decide it expeditiously as far as possible<br \/>\nwithin a period of two months from the date of filing of the<br \/>\nappeal.\n<\/p>\n<p>        With the aforesaid directions, this petition is disposed<br \/>\nof finally.\n<\/p>\n<p>        C.C.as per rules.<\/p>\n<pre>\n\n\n (Krishn Kumar Lahoti)                       (Smt.
