He seeks quashing of criminal<br \/>\ncomplaint being C.R. No.I-224 of 2010 registered at Palanpur City<br \/>\nPolice Station, Dist. Banaskantha (at Annexure-A) on the ground that<br \/>\nno offence is disclosed and on additional ground that the complainant<br \/>\ndoes not wish to press the charges any further.\n<\/p>\n<p>\tUpon<br \/>\nperusal of the complaint it emerges that the complainant young lady<br \/>\nalleged that the petitioner-original accused, by giving her false<br \/>\npromise of getting married and keeping her well after marriage,<br \/>\nexploited her physically. He, however, turned around and on this<br \/>\npremise the said complaint for offences under Sections 406 and 420 of<br \/>\nthe Indian Penal Code has been registered.\n<\/p>\n<p>\tAlong<br \/>\nwith the petition, the petitioner produced an affidavit, jointly<br \/>\nsigned by the complainant as<br \/>\nwell as the petitioner<br \/>\nbefore a public notary on 27.02.2010, stating that all disputes have<br \/>\nbeen resolved between the<br \/>\nparties. The petitioner and the complainant are to be friends and<br \/>\neven the elders of the family have agreed that in future at the<br \/>\noccasion of marriage, they would consider for getting married.\n<\/p>\n<p>\tIt<br \/>\nappears that Section 406 of the Indian Penal Code has been wrongly<br \/>\napplied, which provides for punishment for criminal breach of trust.<br \/>\nPrima facie for section 420 of the Indian Penal Code, I have serious<br \/>\ndoubt whether it can be applied. However, this final question need<br \/>\nnot be decided in this petition, particularly when on record the<br \/>\npetitioner has produced writing of the complainant disclosing that<br \/>\nthe issues have been resolved between<br \/>\nthe parties. It is true that<br \/>\nthe impugned<br \/>\ncomplaint has been lodged after the said declaration, however, with<br \/>\nrespect to the contents of such affidavit, no dispute has been raised<br \/>\non behalf of respondent No.2-original complainant.\n<\/p>\n<p>\tI<br \/>\nhave perused the contents of the said affidavit. Under the<br \/>\ncircumstances, I am of the opinion that the impugned complaint (at<br \/>\nAnnexure-A) is required to be quashed particularly when I find no<br \/>\noffence even otherwise disclosed and the offence would be one at the<br \/>\nmost under Section 405 of the Indian Penal Code.\n<\/p>\n<p>\tIn<br \/>\nthe result, criminal complaint being C.R. No.I-224 of 2010 registered<br \/>\nat Palanpur City Police Station, Dist. Banaskantha (at Annexure-A) is<br \/>\nhereby quashed. Rule is made absolute.
