Alamgir Nutt son of Noor Mohammad Nutt\n                                                    Versus\n                                           The State Of Bihar\n                                                  -----------\n<\/pre>\n<p>3.   27.7.2011                 Heard     learned    Counsel     for    the<\/p>\n<p>                 petitioners and the State.\n<\/p>\n<p>                              The petitioners seek bail in a case<\/p>\n<p>                 instituted for the offence under Sections 366,<\/p>\n<p>                 494\/34 of the Indian Penal Code and 3(1)(X) of the<\/p>\n<p>                 SC\/ST Act.\n<\/p>\n<p>                            Considering that apart from suspicion there<\/p>\n<p>                 is no cogent material against the petitioners, let the<\/p>\n<p>                 petitioners above named, be released on bail on<\/p>\n<p>                 furnishing bail bond of Rs. 5,000\/-(Five thousand)<\/p>\n<p>                 with two sureties of the like amount each or any<\/p>\n<p>                 other surety to be fixed by the court concerned to<\/p>\n<p>                 the satisfaction of learned Chief Judicial Magistrate,<\/p>\n<p>                 Bettiah, West Champaran in connection with<\/p>\n<p>                 Matiyaria P.S. Case No.4 of 2011, subject to the<\/p>\n<p>                 conditions (i) That one of the bailor shall be the<\/p>\n<p>                 father\/brother of the petitioners and the other bailor<\/p>\n<p>                 will be a close relative of the petitioners who will<\/p>\n<p>                 give an affidavit giving genealogy as to how he is<\/p>\n<p>                 related    with   the   petitioners.   The   bailor   will<\/p>\n<p>                 undertake to furnish information to the Court about<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>            any change in address of the petitioners. (ii) That<\/p>\n<p>            the affidavit shall clearly state that the petitioners<\/p>\n<p>            are not an accused in any other case and if they are<\/p>\n<p>            they shall not be released on bail, (iii) That the<\/p>\n<p>            bailor shall also state on affidavit that he will inform<\/p>\n<p>            the court concerned if the petitioners are implicated<\/p>\n<p>            in any other case of similar nature after their<\/p>\n<p>            release in the present case and thereafter the court<\/p>\n<p>            below will be at liberty to initiate the proceeding for<\/p>\n<p>            cancellation of bail on ground of misuse, (iv) That<\/p>\n<p>            the petitioners will give an undertaking that they will<\/p>\n<p>            receive the police papers on the given date and be<\/p>\n<p>            present on date fixed for charge and if they fail to<\/p>\n<p>            do so on two given dates and delays the trial in any<\/p>\n<p>            manner, their bail will be liable to be cancelled for<\/p>\n<p>            reasons of misuse, (v) That the petitioners will be<\/p>\n<p>            well represented on each date if they fail to do so<\/p>\n<p>            on two consecutive dates, their bail will be liable to<\/p>\n<p>            be cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Noor Mohammad Nutt &amp; Anr vs The State Of Bihar on 27 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
