BASANT, J.\n\n            ````````````````````````````````````````````````````\n                     B.A. No. 1477 OF 2008\n            ````````````````````````````````````````````````````\n            Dated this the 10th day of March, 2008\n\n                              O R D E R\n<\/pre>\n<p>            Application for anticipatory bail.          Petitioner faces<\/p>\n<p>allegations in a crime registered alleging offences punishable,<\/p>\n<p>inter alia, under section 3 of the PDPP Act. All other offences<\/p>\n<p>are bailable. Earlier also in another crime allegations under<\/p>\n<p>section 353 IPC have been raised against the petitioner,<\/p>\n<p>submits the learned Public Prosecutor. The learned counsel<\/p>\n<p>for the petitioner submits that such allegations are being<\/p>\n<p>raised against the petitioner with malafide and oblique<\/p>\n<p>motives without any bona fide whatsoever.<\/p>\n<p>      2.    The precise allegation in this case is that the<\/p>\n<p>petitioner had trespassed into the Panchayat office and<\/p>\n<p>caused damage to one plastic chair in the Panchayat office.<\/p>\n<p>There is an ongoing dispute between the Panchayat and the<\/p>\n<p>petitioner regarding the conduct of a meat stall &#8211; renewal of<\/p>\n<p>BA.1477\/08<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>licence, run by the petitioner.       Because of such disputes<\/p>\n<p>which had obliged the petitioner to come to this Court with<\/p>\n<p>Annexure-II WPC.26454\/07, false and vexatious allegations<\/p>\n<p>are being raised against the petitioner, submits the learned<\/p>\n<p>counsel for the petitioner.\n<\/p>\n<p>      3.   The   learned     Public    Prosecutor  refutes    the<\/p>\n<p>allegation but concedes that the State does not want to<\/p>\n<p>oppose the application for anticipatory bail subject to<\/p>\n<p>appropriate conditions which shall ensure the interests of a<\/p>\n<p>proper and efficient investigation. Anticipatory bail can be<\/p>\n<p>granted to the petitioners, it is conceded.<\/p>\n<p>      4.   I am satisfied that the petitioner can be granted<\/p>\n<p>anticipatory bail subject to appropriate conditions.       In the<\/p>\n<p>absence of the opposition by the learned Public Prosecutor, I<\/p>\n<p>am not adverting to the facts in any greater detail in this order.<\/p>\n<p>      5.   In the result, this petition is allowed.     Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of<\/p>\n<p>the petitioner.\n<\/p>\n<p>BA.1477\/08<br \/>\n<span class=\"hidden_text\">                                : 3 :<\/span><\/p>\n<p>      i)    Petitioner shall surrender before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 17.3.2008. He<\/p>\n<p>shall be released on regular bail on condition that he executes<\/p>\n<p>a bond for Rs.25,000\/-(Rupees twenty five thousand only)<\/p>\n<p>with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate.<\/p>\n<p>      ii)   The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 18.3.2008 and 19.3.2008. During this period,<\/p>\n<p>the investigating officer shall be at liberty to interrogate the<\/p>\n<p>petitioner in custody and take all necessary steps for the<\/p>\n<p>proper conduct of the investigation in this crime. Thereafter,<\/p>\n<p>he shall so appear on all Mondays and Fridays between 10<\/p>\n<p>a.m and 12 noon for a period of one month and subsequently<\/p>\n<p>as and when directed by the investigating officer in writing to<\/p>\n<p>do so.\n<\/p>\n<p>      (iii) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above<\/p>\n<p>BA.1477\/08<br \/>\n<span class=\"hidden_text\">                               : 4 :<\/span><\/p>\n<p>shall thereafter stand revoked and the police shall be at liberty<\/p>\n<p>to arrest the petitioner and deal with him in accordance with<\/p>\n<p>law, as if these directions were not issued at all.<\/p>\n<p>      (iv) If he were arrested prior to 17.3.2008, he shall be<\/p>\n<p>released from custody on his executing a bond for<\/p>\n<p>Rs.25,000\/- (Rupees twenty five thousand only) without any<\/p>\n<p>sureties, undertaking to appear before the learned Magistrate<\/p>\n<p>on 17.3.2008.\n<\/p>\n<\/p>\n<p>                                          (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rafi vs State Of Kerala Rep.
