It   ~<\/p>\n<p>ease of the appellants that  one <\/p>\n<p>person was deajiing with V&#8217;~,th.i._.&#8217;st..:&#8217; ratt\u00e9r &#8220;fry<\/p>\n<p>approaohing as. counsel. for: -giviirig  ;i.x;st.i\u00a5&amp;:;tVions:\u00a7.<br \/>\nEven in the partition   to; the<br \/>\nlearned Counsel for   the<\/p>\n<p>appellants got some   or-it other in<\/p>\n<p>survey tho; gt: between the<br \/>\nparties  &#8221; portion of survey<br \/>\nNo.69    guntas came to be sold.\n<\/p>\n<p>-V  te\ufb01pondent they are claiming the<br \/>\n ~A.bai5nging to the aypeliants itxaing<br \/>\n by over: inciting the fact that in<br \/>\n the  v\ufb01trtior of the land. Municipality<\/p>\n<p> formed a road.\n<\/p>\n<p> &#8216;&gt;6! The contromxsy is whet.hex:- in the portion<\/p>\n<p>jfr\u00e9tainacs by the appellants in Survey notes the<\/p>\n<p>  pi*es;e&#8221;\u00e9xzti&#8217;i\u00a7.g  their case .<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>mortgage in favour of the respondent woeld fall<br \/>\nor not?\n<\/p>\n<p>&#8216;3. The suit was decreed partly and the same<\/p>\n<p>was challenged by the respondent against these<\/p>\n<p>appellants. The learned Judge of<br \/>\nAppellate Court has set aside the judgment of \u00a3\u00a7\u00e9f&#8221;&#8216;&#8221;<br \/>\ntrial ccurt by ranitting   <\/p>\n<p>trial court for local inspeetiea&#8221; by _a, c\u00a7\ufb01\u00a7tT*[<\/p>\n<p>Cami.-ssioner. This order  to V be an<\/p>\n<p>13.7 2007 and at no where in the gatira_ju\u00a7gment<\/p>\n<p>there   _ te the fact that the<\/p>\n<p>Counsel appeari\ufb01g  appellants hereunder<\/p>\n<p>Zbefareg&#8217; &#8221; the it &#8220;B&#8217;,ir&#8217;et V&#8221; Appellate Court was not<\/p>\n<p>In order to show that<\/p>\n<p> &#8221;  not intitnate the disposal of the<\/p>\n<p> matteti  appellants, the best infornation<br \/>\n  been 1110 file the affidavit of the<br \/>\n  who represented before the Court. The very facts placed<\/p>\n<p> _,;,e\u00a3o\u00a3o,_&#8221;&#8216;%tnga.&#8221;=::g:.:\u00a3zt would indicate for the best<\/p>\n<p>.;\u00e9z.\u00a7ons  to the parties, they remained quiet<\/p>\n<p>   and now all the four of them contend<\/p>\n<p> had interse disputes. It is noticed om<\/p>\n<p> oftvttha apwllants was a government servant and<\/p>\n<p> ooother appellant was suffering from mzltiple<\/p>\n<p>arthritis.
