At\u00a0the\u00a0outset,\u00a0the\u00a0Appellant\u00a0submitted\u00a0that\u00a0even\u00a0though\u00a0he\u00a0had\u00a0sent\u00a0a\u00a0letter\u00a0dated\u00a021.2.11\u00a0indicating\u00a0<\/p>\n<p>       change\u00a0of\u00a0his\u00a0address\u00a0\u00a0,\u00a0the\u00a0PIO\u00a0had\u00a0deliberately\u00a0sent\u00a0the\u00a0reply\u00a0to\u00a0his\u00a0old\u00a0address\u00a0and\u00a0that\u00a0too\u00a0after\u00a0<\/p>\n<p>       his\u00a0having\u00a0filed\u00a0the\u00a0first\u00a0appeal\u00a0\u00a0on\u00a021.3.11.\u00a0He\u00a0stated\u00a0that\u00a0he\u00a0received\u00a0the\u00a0\u00a0reply\u00a0dt.7.4.11\u00a0from\u00a0the\u00a0<\/p>\n<p>       Respondents\u00a0against\u00a0which\u00a0he\u00a0had\u00a0preferred\u00a0an\u00a0appeal\u00a0dt.18.5.11\u00a0with\u00a0the\u00a0Appellate\u00a0Authority\u00a0and\u00a0<\/p>\n<p>       that\u00a0no\u00a0response\u00a0has\u00a0been\u00a0received\u00a0from\u00a0the\u00a0FAA\u00a0till\u00a0date.\u00a0 \u00a0 \u00a0The\u00a0Respondents\u00a0submitted\u00a0that\u00a0the\u00a0<br \/>\n      delay\u00a0was\u00a0not\u00a0deliberate\u00a0and\u00a0the\u00a0change\u00a0of\u00a0address\u00a0was\u00a0not\u00a0noted\u00a0\u00a0due\u00a0to\u00a0oversight.\u00a0\u00a0He\u00a0added\u00a0that\u00a0<\/p>\n<p>     the\u00a0first\u00a0appeal\u00a0dt.18.5.11\u00a0was\u00a0neither\u00a0received\u00a0by\u00a0him\u00a0nor\u00a0by\u00a0the\u00a0RTI\u00a0Cell.\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>3.   The\u00a0Commission\u00a0at\u00a0this\u00a0stage\u00a0noted\u00a0that\u00a0the\u00a0Appellant\u00a0has\u00a0filed\u00a0two\u00a0appeals\u00a0with\u00a0the\u00a0First\u00a0Appellate\u00a0<\/p>\n<p>     Authority\u00a0and\u00a0in\u00a0this\u00a0connection\u00a0would\u00a0like\u00a0to\u00a0draw\u00a0the\u00a0attention\u00a0of\u00a0the\u00a0Appellant\u00a0to\u00a0Section\u00a0\u00a0of\u00a0the\u00a0RTI\u00a0<\/p>\n<p>     Act\u00a0which\u00a0allows\u00a0only\u00a0one\u00a0first\u00a0appeal.\u00a0\u00a0Instead\u00a0of\u00a0a\u00a0\u00a0second\u00a0appeal\u00a0to\u00a0the\u00a0First\u00a0Appellate\u00a0authority\u00a0the\u00a0<\/p>\n<p>     Appellant\u00a0ought\u00a0to\u00a0have\u00a0preferred\u00a0an\u00a0appeal\u00a0before\u00a0the\u00a0Commission.\u00a0The\u00a0second\u00a0appeal\u00a0before\u00a0the\u00a0<\/p>\n<p>     FAA\u00a0is\u00a0therefore\u00a0not\u00a0being\u00a0taken\u00a0into\u00a0consideration\u00a0by\u00a0the\u00a0Commission.\u00a0<\/p>\n<p>3.   The\u00a0Appellant\u00a0pointed\u00a0out\u00a0\u00a0various\u00a0deficiencies\u00a0in\u00a0the\u00a0information\u00a0provided\u00a0to\u00a0him\u00a0against\u00a0some\u00a0points\u00a0<\/p>\n<p>     which\u00a0were\u00a0then\u00a0taken\u00a0up\u00a0for\u00a0discussion\u00a0by\u00a0the\u00a0Commission.\u00a0The\u00a0following\u00a0decisions\u00a0were\u00a0taken\u00a0<\/p>\n<p>     consequent\u00a0to\u00a0the\u00a0discussions:\u00a0\n<\/p>\n<p>     i)        On\u00a0perusal\u00a0of\u00a0the\u00a0notings\u00a0furnished\u00a0against\u00a0item\u00a0No.2\u00a0it\u00a0was\u00a0noted\u00a0that\u00a0the\u00a0notings\u00a0with\u00a0<\/p>\n<p>     S.Nos.10, \u00a0 12, \u00a0 13, \u00a0 15, \u00a0 18, \u00a0 22, \u00a0 23 \u00a0 and\u00a0 24 \u00a0 have\u00a0 not\u00a0 been \u00a0 provided. \u00a0 \u00a0 Copies\u00a0 of \u00a0 the\u00a0 same\u00a0 to \u00a0 be\u00a0<\/p>\n<p>     furnished\u00a0,\u00a0if\u00a0available\u00a0in\u00a0the\u00a0file.\n<\/p>\n<p>     ii)       Against\u00a0item\u00a06\u00a0of\u00a0the\u00a0application,\u00a0though\u00a0the\u00a0Appellant\u00a0had\u00a0sought\u00a0all\u00a0the\u00a0correspondence\u00a0<\/p>\n<p>     and\u00a0replies\u00a0with\u00a0their\u00a0enclosures,\u00a0the\u00a0enclosures\u00a0to\u00a0annexure\u00a0XVI\u00a0and\u00a0XVII\u00a0\u00a0have\u00a0not\u00a0been\u00a0supplied\u00a0<\/p>\n<p>     i.e. \u00a0 ACRs \u00a0 of \u00a0 the \u00a0 candidate, \u00a0 marks, \u00a0 DPC \u00a0 proceedings \u00a0 etc. \u00a0 The \u00a0 Commission \u00a0 directs \u00a0 the \u00a0 PIO \u00a0 to\u00a0<\/p>\n<p>     withhold\u00a0the\u00a0copies\u00a0of\u00a0ACRs\u00a0of\u00a0the\u00a0others\u00a0as\u00a0the\u00a0same\u00a0are\u00a0exempt\u00a0from\u00a0disclosure\u00a0under\u00a0Section\u00a08(1)<\/p>\n<p>     (j)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0.\u00a0The\u00a0remaining\u00a0information\u00a0may\u00a0be\u00a0provided\u00a0after\u00a0severing\u00a0under\u00a0Section\u00a010(1)\u00a0any\u00a0<\/p>\n<p>     information\u00a0that\u00a0is\u00a0personal\u00a0in\u00a0nature\u00a0u\/s\u00a08(1)(j)\u00a0of\u00a0the\u00a0RTI\u00a0Act.\u00a0\u00a0<\/p>\n<p>     iii)      Enclosures\u00a0to\u00a0annexures\u00a0against\u00a0\u00a0point\u00a09,\u00a0to\u00a0be\u00a0provided\u00a0.<\/p>\n<p>     iv)       Notings\u00a0and\u00a0orders\u00a0on\u00a0annexure\u00a0XVI\u00a0and\u00a0XVII\u00a0against\u00a0point\u00a02\u00a0have\u00a0\u00a0not\u00a0been\u00a0\u00a0furnished\u00a0.\u00a0<\/p>\n<p>     Copies\u00a0of\u00a0the\u00a0same\u00a0may\u00a0be\u00a0provided.\u00a0\n<\/p>\n<p>     v)        Shri \u00a0 S.Venugopalachari&#8217;s \u00a0 letter \u00a0 to \u00a0 Railway \u00a0 Minister \u00a0 dt.22.5.01 \u00a0 indicated \u00a0 on \u00a0 page \u00a0 11 \u00a0 of\u00a0<\/p>\n<p>     Annexure\u00adIII\u00a0and\u00a0in\u00a0Annexure\u00a0VI\u00a0\u00a0may\u00a0be\u00a0supplied.<\/p>\n<p>4.   The\u00a0information\u00a0should\u00a0reach\u00a0the\u00a0Appellant\u00a0by\u00a020.10.11.<\/p>\n<p>     \u00a0<\/p>\n<p>5.   The\u00a0Commission\u00a0also\u00a0directs\u00a0the\u00a0PIO\u00a0to\u00a0show\u00a0cause\u00a0as\u00a0to\u00a0why\u00a0penalty\u00a0should\u00a0not\u00a0be\u00a0imposed\u00a0upon\u00a0<\/p>\n<p>     him\u00a0u\/s20(1)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0for\u00a0not\u00a0responding\u00a0to\u00a0the\u00a0RTI\u00a0Application\u00a0with\u00a0the\u00a0prescribed\u00a0time\u00a0limit.\u00a0<\/p>\n<p>     He\u00a0\u00a0may\u00a0submit\u00a0his\u00a0response\u00a0\u00a0to\u00a0the\u00a0Commission\u00a0by\u00a027.10.11.<\/p>\n<p>6.
