L. Jani waives service<br \/>\nof Rule on behalf of the respondent-State.  In the facts and<br \/>\ncircumstances of the case, the matter is taken up for hearing today.\n<\/p>\n<p>2.\t\tThis<br \/>\nis an application preferred under Section 439 of the Code of Criminal<br \/>\nProcedure seeking regular bail of the petitioner in connection with<br \/>\nC. R. No. 341 of 2007 filed at Sector-7 Police Station, Gandhinagar<br \/>\nfor the offences punishable under Sections 409, 420, 406 and 114 of<br \/>\nthe Indian Penal Code.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate Mr. L. A. Amar for the petitioner submitted that considering<br \/>\nthe role attributed to the petitioner, which is reflected in the FIR,<br \/>\nit is a fit case to release the petitioner on bail.  The petitioner<br \/>\nwas working in the Bank at the material point of time and he was not<br \/>\ninvolved in the alleged offences under Sections 409, 420, 406 and 114<br \/>\nof the Indian Penal Code.  The learned Advocate submitted that<br \/>\nconsidering the role played by the petitioner, the prayer, as set<br \/>\nout, in the petition be granted.  The learned Advocate also placed<br \/>\nreliance on the affidavit filed by Surendranath Umapati Pandey which<br \/>\nwas produced in Criminal Miscellaneous Application No. 228 of 2008<br \/>\nbefore the learned Additional Sessions Judge at Gandhinagar.  The<br \/>\nlearned Advocate further submitted that in Criminal Miscellaneous<br \/>\nApplication No. 7969 of 2008, the accused was granted bail by this<br \/>\nCourt and considering the parity, the petitioner be also granted<br \/>\nbail.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdditional Public Prosecutor Mr. H. L. Jani representing the<br \/>\nrespondent-State submitted that considering the role attributed to<br \/>\nthe petitioner and the nature of the offences in which the petitioner<br \/>\nis involved, it is not a fit case to grant bail in favour of the<br \/>\npetitioner.  The learned Additional Public Prosecutor submitted that<br \/>\nhuge amount of Rs. 2,55,685\/-, which was required to be paid to P. K.<br \/>\nChaudhary Arts College, Gandhinagar for the year 2005-06 towards the<br \/>\nscholarship, was siphoned off by the petitioner along with other<br \/>\naccused persons, and considering the seriousness of the offences and<br \/>\nthe involvement of the petitioner in other cases of like nature, the<br \/>\npetition deserves to be rejected.\n<\/p>\n<p>5.\t\tHaving<br \/>\nconsidered the rival submissions and on perusal of the averments made<br \/>\nin the petition as well as the FIR, it is clear that the petitioner<br \/>\nis booked for the offences punishable under Sections 409, 420, 406<br \/>\nand 114 of the Indian Penal Code.  Considering the role attributed to<br \/>\nthe petitioner in FIR and taking into account the seriousness of the<br \/>\noffences in which the petitioner is booked for the offences stated in<br \/>\nthe FIR, it is not a fit case to grant bail to the petitioner.  The<br \/>\npetitioner was involved in siphoning off the huge amount of Rs.<br \/>\n2,55,685\/- along with other accused which was granted by the State<br \/>\nGovernment for the purpose of providing scholarship to P. K.<br \/>\nChaudhary Arts College, Sector-7, Gandhinagar for the year 2005-06.<br \/>\nInstead of giving that amount to the College, the entire amount was<br \/>\nmisappropriated.  The learned Advocate for the petitioner has placed<br \/>\nreliance on the order passed in Criminal Miscellaneous Application<br \/>\nNo. 7969 of 2008 dated 30-06-2008 (Coram: Z. K. Saiyed, J.) and<br \/>\nsubmitted that parity is required to be maintained and the petitioner<br \/>\nis required to be released on bail.  However, considering the facts<br \/>\nand circumstances of the case, the petitioner, in my considered view,<br \/>\ncannot claim parity as the huge amount has been misappropriated by<br \/>\nthe petitioner along with other co-accused.  The petitioner is also<br \/>\ninvolved in number of cases of similar nature and, therefore, the<br \/>\nCourt cannot be oblivious to this aspect.  In view of the aforesaid<br \/>\nfacts and circumstances of the case, the petition is devoid of<br \/>\nmerits, and, therefore, it is liable to be dismissed.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe foregoing reasons, the petition fails and is dismissed.\n<\/p>\n<p>[H.\n<\/p>\n<p>B.
