     The common petitioner in these three cases has come<\/p>\n
before this court complaining about a direction for deposit of<\/p>\n
cash security as condition for release on bail. The petitioner<\/p>\n
faces allegations in as many as seven crimes all under Section<\/p>\n
379 I.P.C.   The petitioner applied for bail and the learned<\/p>\n
Magistrate granted bail subject to conditions including the<\/p>\n
condition that amounts must be deposited as cash security by the<\/p>\n
sureties. Bonds are to be executed with two solvent sureties and<\/p>\n
each such surety is directed to deposit amounts. In one case, the<\/p>\n
amount ordered to be deposited was Rs.10,000\/-. The court of<\/p>\n
Session has reduced the same to Rs.8,000\/-. In six other cases,<\/p>\n
the amount which each surety has been directed to deposit was<\/p>\n
Rs.20,000\/- and the Sessions Court has reduced the same to<\/p>\n
Rs.15,000\/-.\n<\/p>\n
     2.    The petitioner remains in custody from 14\/6\/2008.<\/p>\n
The impugned orders were passed long earlier; but though<\/p>\n
Crl.M.C.Nos.128,146 and 202 of 2009  2<\/p>\n
under the impugned orders the petitioner has been granted bail,<\/p>\n
he is unable to avail the benefits of that order because of the<\/p>\n
onerous nature of the conditions imposed. The petitioner is in<\/p>\n
prison. He has been asked to get two sureties in each case who<\/p>\n
shall be willing to pay such huge amounts – Rs.8,000\/- in one<\/p>\n
case and Rs.15,000\/- in other six cases. The petitioner, now in<\/p>\n
prison, cannot get such sureties who are in a position to make<\/p>\n
such huge deposit of cash security.         Virtually bail has been<\/p>\n
denied to him. The petitioner, who hails from the economically<\/p>\n
weaker section of the community, will never be able to comply<\/p>\n
with the condition and avail the benefit of the bail order. In<\/p>\n
these circumstances, the learned counsel for the petitioner prays<\/p>\n
that the directions in the impugned modified orders that the<\/p>\n
petitioner must make cash deposit may be set aside.             The<\/p>\n
petitioner may be permitted to be released on bail subject to any<\/p>\n
reasonable terms and conditions.\n<\/p>\n
      3.    Notice was given to the learned Public Prosecutor.<\/p>\n
The learned Public Prosecutor only submits that appropriate<\/p>\n
orders may be passed; but it may be ensured that the petitioner<\/p>\n
shall be available for trial and shall not repeat the offence during<\/p>\n

the pendency of the proceedings.\n<\/p>\n
      4.    Having considered all the relevant circumstances, I<\/p>\n
am satisfied that the prayer of the petitioner deserves to be<\/p>\n
considered sympathetically and the condition of cash deposit by<\/p>\n
the sureties can be deleted.\n<\/p>\n
      5.    In the result, these petitions are allowed. In all these<\/p>\n
seven cases, the petitioner shall be released on bail on the<\/p>\n
following terms and conditions:\n<\/p>\n
      i)    He shall be released on bail on condition that he<\/p>\n
executes bonds as directed by the learned Magistrate with two<\/p>\n
solvent sureties each for the like sum to the satisfaction of the<\/p>\n
learned Magistrate.\n<\/p>\n
      ii)   The learned Magistrate, I clarify, need not insist on<\/p>\n
deposit of cash security by the sureties. The sureties can be<\/p>\n
accepted if the learned Magistrate is satisfied otherwise about<\/p>\n
their solvency and sufficiency.\n<\/p>\n
      Hand over copy of this order to the learned counsel for the<\/p>\n
petitioner.\n<\/p>\n<\/p>\n
