                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                 Cr.Misc. No.33151 of 2010\n                Brij Kishore Singh, Son of Nand Lal Singh, resident of village-Paharpur-Ahlad,\n                P.S.-Sahebganj, District-Muzaffarpur.                            -Petitioner.\n                                         VERSUS\n                The State of Bihar                                            -Opposite Party.\n                                          -----------\n<\/pre>\n
03     21.12.2010                        The petitioner seeks anticipatory bail in connection<\/p>\n
                       with Sahebganj P.S. Case No.140 of 2009 registered under Section-<\/p>\n
                       364\/34 of the Indian Penal Code read with Section-27 of the Arms<\/p>\n
                       Act.     Petitioner is not named in the F.I.R. but in course of<\/p>\n
                       investigation several persons named the petitioner.<\/p>\n
                                         Learned counsel for the petitioner submits that it is the<\/p>\n
                       family of the person abducted who has named the petitioner due to<\/p>\n
                       personal enmity.\n<\/p>\n
                                         In my view, these facts are matter of records which can<\/p>\n
                       be verified by the Court below with reference to materials available in<\/p>\n
                       the case diary.\n<\/p>\n
                                         In the facts aforesaid, I am not inclined to grant<\/p>\n
                       anticipatory bail to the petitioner. The petitioner may surrender within<\/p>\n
                       four weeks from toady and the Court below would consider his case<\/p>\n
                       without being prejudiced by order of this Court.<\/p>\n
                                         This application is disposed of accordingly.<\/p>\n
