Mr.Mankad, learned advocate has filed appearance for<br \/>\nrespondent No.1 and Mr.Thakkar, learned advocate for respondent nos.4<br \/>\nto 7 and Mr.Soni, learned AGP for respondent Nos.8 to 12.\n<\/p>\n<p>3.\tConsidering<br \/>\nthe facts and circumstances it appears that the impugned order was<br \/>\npassed on 03.12.2008. Thereafter the petitioner preferred two writ<br \/>\npetitions before this Court one was Special Civil Application<br \/>\nNo.27445 of 2007 and another was Special Civil Application No.10904<br \/>\nof 2009. Further, the review application was also preferred and the<br \/>\nsame came to be dismissed.\n<\/p>\n<p>4.\tUnder<br \/>\nthe circumstances looking to the observations made by this Court in<br \/>\nSpecial Civil Application coupled with the aspects that appeal could<br \/>\nbe filed and the Special Civil Application was wrongly filed, it can<br \/>\nbe said that the petitioners were prosecuting the wrong forum and<br \/>\nunder the circumstances it would be a valid ground to condone the<br \/>\ndelay. Further, Special Civil Application is filed on 25.01.2011 and<br \/>\nthe present appeal has been filed on 09.02.2011. It further appears<br \/>\nthat there is a case to be considered in the appeal. Under the<br \/>\ncircumstances we find it proper to exercise the discretion to condone<br \/>\nthe delay by taking lenient view in the matter.\n<\/p>\n<p>5.\tHowever,<br \/>\neven if lenient view is taken on the aspect of delay, the petitioner<br \/>\ncan not get away from paying the cost for the delay by way of<br \/>\ncompensation on the aspects of delay.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe facts and circumstances appropriate cost for respondent Nos.1, 2<br \/>\nand 3 shall be Rs.2500\/-, for respondent Nos.4 to 7 shall be Rs.5,000<br \/>\nand for respondent Nos.8 to 12 shall be Rs.2500, total cost of<br \/>\nRs.10,000\/-.\n<\/p>\n<p>7.\tAs<br \/>\nthe amount of cost has already been deposited as per order dated<br \/>\n15.03.2011 passed by this Court, the respondent concerned can be<br \/>\npermitted to withdraw the quantum of the cost.\n<\/p>\n<p>8.\tIn<br \/>\nview of the aforesaid the delay in preferring the appeal has been<br \/>\ncondoned on condition to pay the costs as stated above. As the amount<br \/>\nof cost has already been deposited and condition is complied with,<br \/>\nthe concerned respondent shall be at the liberty to withdraw the<br \/>\namount of cost to the extent ordered by this Court.\n<\/p>\n<p>9.\tApplication<br \/>\nis allowed to the aforesaid extent.
