Sinha\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>(Arising out of SLP ) No. 14972 of 2004)<\/p>\n<p>SANTOSH HEGDE, J.\n<\/p>\n<p>\tHeard learned counsel for the parties.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tThe appellant had filed a Civil Suit No.541 of 2000 for<br \/>\npossession of the suit scheduled property with an application<br \/>\nunder Order 39 Rules 1 and 2 CPC, seeking injunction<br \/>\nrestraining the respondent herein from alienating the suit<br \/>\nproperty and putting up any construction thereon. The trial<br \/>\ncourt on the interim application filed by the appellant granted<br \/>\nan order of temporary injunction, as prayed for.\n<\/p>\n<p>\tThe appeal filed by the respondent herein before the<br \/>\nlearned District Judge came to be allowed holding that<br \/>\nalienation made, if any, will be subject to the law of lis pendens<br \/>\nand constructions, if any, put by the respondent will have to be<br \/>\nremoved at his own risk and cost in the event of the suit being<br \/>\ndecreed.\n<\/p>\n<p>\tA revision filed against the said order to the High Court<br \/>\ncame to be dismissed by the impugned order wherein the High<br \/>\nCourt recorded an oral undertaking given by the learned<br \/>\ncounsel which is as follows :\n<\/p>\n<p>&#8220;Learned counsel for the respondent, on<br \/>\ninstruction from Rajinder Dass son of<br \/>\nBaldev Dass, on the other hand, has stated<br \/>\nthat the respondent has no intention of<br \/>\nalienating any part of the property and<br \/>\nfurther that the defendant shall raise<br \/>\nconstruction if any at his own risk costs<br \/>\nwithout claiming any compensation. It is<br \/>\nfurther stated that if the defendant inducts<br \/>\nany tenant in any such premises so<br \/>\nconstructed, the person inducted would be<br \/>\nmade aware of the pendency of the litigation<br \/>\nand would be bound by the judgment and<br \/>\ndecree passed in the suit.&#8221;\n<\/p>\n<p>\tIt is in view of the above statement made by the learned<br \/>\ncounsel for the respondent that the High Court without<br \/>\nconsidering the grounds raised in the revision petition<br \/>\nproceeded to dismiss the petition.\n<\/p>\n<p>          Mr. R.S. Sachhar, learned senior counsel appearing for<br \/>\nthe appellant, contended that generally during the pendency of<br \/>\nlitigation courts protect the status quo existing on the date of the<br \/>\nsuit and it is only in exceptional circumstances where<br \/>\nirreparable damage is feared, the courts permit change of status<br \/>\nquo. His further contention was that in the present case no such<br \/>\ncase is made out by the respondent and the trial court was<br \/>\njustified in protecting the status quo as on the date of the suit.\n<\/p>\n<p>Mr. A.V. Palli, learned counsel for the respondent,<br \/>\ncontended that both the lower appellate court and the High<br \/>\nCourt were justified in making the impugned order because the<br \/>\nappellant has not established any prima facie case and if the suit<br \/>\nproperty is to be allowed to remain in the present condition, the<br \/>\nrespondent will be put to great hardship and an irreparable loss.<br \/>\nWhile it is true that the lower appellate court did go into<br \/>\nthe question of prima facie case and held that the appellant had<br \/>\nnot made out any such case, the High Court did not go into that<br \/>\nquestion at all.\n<\/p>\n<p>\tBe that as it may, Mr. Sachhar is right in contending that<br \/>\nunless and untill a case of irreparable loss or damage is made<br \/>\nout by a party to the suit, the court should not permit the nature<br \/>\nof the property being changed which also includes alienation or<br \/>\ntransfer of the property which may lead to loss or damage being<br \/>\ncaused to the party who may ultimately succeed and may<br \/>\nfurther lead to multiplicity of proceedings. In the instant case no<br \/>\nsuch case of irreparable loss is made out except contending that<br \/>\nthe legal proceedings are likely to take a long time, therefore,<br \/>\nthe respondent should be permitted to put the scheduled<br \/>\nproperty to better use. We do not think in the facts and<br \/>\ncircumstances of this case, the lower appellate court and the<br \/>\nHigh Court were justified in permitting the respondent to<br \/>\nchange the nature of property by putting up construction as also<br \/>\nby permitting the alienation of the property, whatever may be<br \/>\nthe condition on which the same is done. In the event of the<br \/>\nappellant&#8217;s claim being found baseless ultimately, it is always<br \/>\nopen to the respondent to claim damages or, in an appropriate<br \/>\ncase, the court may itself award damages for the loss suffered,<br \/>\nif any, in this regard. Since the facts of this case do not make<br \/>\nout any extraordinary ground for permitting the respondent to<br \/>\nput up construction and alienate the same, we think both the<br \/>\ncourts below, namely, the lower appellate court and the High<br \/>\nCourt erred in making the impugned orders.
