SANKARAN, J.\n                    ---------------------------\n                     B.A. No.7851 of 2009\n               ------------------------------------\n            Dated this the 28th day of January, 2010\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under<\/p>\n<p>Section 438 of the Code of Criminal Procedure. The petitioner<\/p>\n<p>is accused No.2 in Crime No.568\/2009 of Ponkunnam Police<\/p>\n<p>Station, Kottayam.\n<\/p>\n<p>     2.    The offences alleged against the petitioner are<\/p>\n<p>under Sections 406 and 420 read with Section 34 of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p>     3.    The learned Public Prosecutor submitted that after<\/p>\n<p>completing the investigation, charge sheet was laid in the case<\/p>\n<p>on 31\/12\/2009 before the court of the Judicial Magistrate of<\/p>\n<p>the First Class-II, Kanjirappally.<\/p>\n<p>     4.    The learned counsel for the petitioner submitted<\/p>\n<p>that the petitioner apprehends arrest even now, since the<\/p>\n<p>investigating officer is free to arrest him under the pretext of<\/p>\n<p>further investigation under Section 173(8) of the Code of<\/p>\n<p>Criminal Procedure.\n<\/p>\n<p>     5.    The learned Public Prosecutor submitted that there<\/p>\n<p>B.A. No.7851\/2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>is no proposal to conduct any further investigation and even if it<\/p>\n<p>is necessitated, an appropriate report will be filed before the<\/p>\n<p>court.\n<\/p>\n<p>      The submission made by the learned Public Prosecutor is<\/p>\n<p>recorded and the Bail Application is closed with liberty to the<\/p>\n<p>petitioner to seek regular bail.\n<\/p>\n<\/p>\n<p>                                K.T.
