Justice M.SASIDHARAN NAMBIAR\n\n Dated :01\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3041 OF 2009\n              ------------------------------------------\n\n                Dated      1st October 2009\n\n\n                           O R D E R\n<\/pre>\n<p>           Petitioners are accused in C.C.408\/2004 on<\/p>\n<p>the  file   of    Judicial          First        Class    Magistrate,<\/p>\n<p>Chalakkudy.  Petitioners         are      being       tried for   the<\/p>\n<p>offences under Sections 2(ia) (a) (b) (m) 7(1) (v)<\/p>\n<p>read with Section 16(1) (a) (i) (ii) of Prevention of<\/p>\n<p>Food Adulteration Act. Petitioners sought to adduce<\/p>\n<p>evidence against the report of Central Food Laboratory<\/p>\n<p>which   was   dismissed          under         Annexure-IV    order.<\/p>\n<p>Petitioners thereafter filed Annexure-V petition to<\/p>\n<p>re-call DW1 to put some more questions which are<\/p>\n<p>originally  objected        by      the       prosecutor.     Learned<\/p>\n<p>Magistrate dismissed the petition as per order dated<\/p>\n<p>10\/8\/2009. This petition is filed under Section 482 of<\/p>\n<p>Code of Criminal Procedure to quash Annexure-IV order<\/p>\n<p>and to allow Annexure-V petition.<\/p>\n<p>         2.   Learned            counsel            appearing     for<\/p>\n<p>petitioners was heard.\n<\/p>\n<p>         3.   Argument of the learned counsel is that<\/p>\n<p>CRMC 3041\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>report of the Central Forensic Laboratory was received<\/p>\n<p>seven months after the article was purchased by the<\/p>\n<p>Food Inspector and in such circumstances, learned<\/p>\n<p>Magistrate should have granted permission to let in<\/p>\n<p>evidence to contradict the findings    of the Central<\/p>\n<p>Forensic Laboratory and in any case learned Magistrate<\/p>\n<p>would be re-called DW1 to put the question which was<\/p>\n<p>originally objected to.\n<\/p>\n<p>          4.  On hearing the learned counsel, I find<\/p>\n<p>no illegality or irregularity warranting interference<\/p>\n<p>at this stage. Being interlocutory orders, petitioners<\/p>\n<p>are entitled to challenge the order along with the<\/p>\n<p>final  orders.
