Appellants<br \/>\n\t  Versus<br \/>\nMiss Asha Trilokbhai Shah etc.\t\t  &#8230;.. Respondents<br \/>\n\t  JUDGMENT<br \/>\nR.M. Sahai, J.<\/p><\/blockquote>\n<p>     An important  question in\trelation to  the adoption of<br \/>\ninfants from  orphanage or  ashrams by\tforeign nationals is<br \/>\nraised by  the appellants,  who claim  to be social workers.<br \/>\nThey  approached  the  High  Court,  invoked  its  appellate<br \/>\njurisdiction against the order passed by the District Judge,<br \/>\nRajkot, allowing  the application  filed by  Superintendent,<br \/>\nKathiawar Nirashrit Balashram as Power of Attorney holder of<br \/>\na Norwegian  couple under  Section 7  of the  Guardians\t and<br \/>\nWards Act,  1890 and  appointing the Norwegian couple as the<br \/>\nguardian of  the child\twith certain conditions mentioned in<br \/>\nthe order.  By the  time the appeal came up for hearing, the<br \/>\nlaw of adoption by foreign nationals was streamlined by this<br \/>\nCourt in  two decisions:  <a href=\"\/doc\/551554\/\">Lakshmi Kant\tPandey v.  Union  of<br \/>\nIndia<\/a> (1984)  2 SCR  795 and  <a href=\"\/doc\/346574\/\">Laxmi Kant  Pandey v. Union of<br \/>\nIndia &amp;\t Anr.<\/a> (1985)  Supp. 3  SCR 71.\tThe  learned  Single<br \/>\nJudge, therefore,  after examining the conditions imposed by<br \/>\nthe District  Judge held  that the  guidelines laid  down by<br \/>\nthis Court  had been  scrupulously followed.  The order\t was<br \/>\nmaintained in appeal as well.\n<\/p>\n<p>     The  guidelines  laid  down  by  the  Court  are  quite<br \/>\nexhaustive. What is urged is that they are not being carried<br \/>\nout either  in letter or spirit. It is, therefore, necessary<br \/>\nto reiterate  the guidelines  laid down by this Court in the<br \/>\ncase of\t Lakshmi Kant  Pandey (supra)  and further  make  it<br \/>\nclear that  whenever an\t application is filed for permission<br \/>\nto adopt  a child  by a foreign national then the guidelines<br \/>\nwould be  strictly  adhered  to.  The  authority  permitting<br \/>\nadoption should\t explain to  the biological  parent  of\t the<br \/>\nchild about  the nature\t and effect  of the adoption and the<br \/>\npossible permanent  loss  of  contact  from  the  child.  In<br \/>\nabsence of  a  finding\tthat  the  authorised  officer\ttook<br \/>\nprecaution to  explain the  effect of  adoption\t it  may  be<br \/>\nrendered infirm.  This is  demonstrated by the facts of this<br \/>\ncase as\t the Superintendent,  as holder of Power of Attorney<br \/>\nof  the\t Norwegian  couple,  became  the  applicant  and  as<br \/>\nSuperintendent of  the Ashram  gave the\t child in  adoption.<br \/>\nThat was  not proper.  It was the duty of the Superintendent<br \/>\nto have\t contacted the\tmother and  the father, if they were<br \/>\nknown, and  to explain to them the effect of adoption unless<br \/>\nthey were  not available.  However, we do not interfere with<br \/>\nthe orders  passed by  the courts  below, but  as  indicated<br \/>\nabove, the  guidelines have  to\t be  enforced  strictly,  as<br \/>\nviolation of  the same\tmay not\t only  render  the  adoption<br \/>\ninfirm, but  may  lead\tto  proceeding\tagainst\t the  person<br \/>\ninfringing the same.\n<\/p>\n<p>     The appeals  are thus  disposed of\t by reiterating\t the<br \/>\nguidelines laid\t down by  this Court  and stating  that\t any<br \/>\nviolation of  these or\tnon-compliance may  lead to adoption<br \/>\nbeing declared\tinvalid and  expose the persons concerned to<br \/>\nstrict action including prosecution.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sumanlal Chhotalal Kamdar Etc vs Miss Asha Trilokbhai Shah Etc on 9 May, 1995 Equivalent citations: 1995 AIR 1892, 1995 SCC (3) 700 Author: R Sahai Bench: Sahai, R.M.
