JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tIn<br \/>\nthis appeal, appellant challenges the judgment and order dated<br \/>\n21.10.2010 passed by the learned Single Judge in SCA No. 6880 of<br \/>\n1990, whereby the learned Single Judge, having found no merit in the<br \/>\npetition, summarily rejected the same.\n<\/p>\n<p>2.\tThe<br \/>\nrecord reveals that the challenge before the learned Single Judge was<br \/>\nto the order dated 28.7.1989 passed by Gujarat Revenue Tribunal in<br \/>\nRevision Application No.TEN-BS-150 of 1984, whereby the Revision<br \/>\nApplication preferred by the petitioner was rejected.\n<\/p>\n<p>3.\tBefore<br \/>\nthe learned Single Judge, Gujarat Revenue Tribunal was not a party<br \/>\nrespondent.  In the absence of Gujarat Revenue Tribunal, whose order<br \/>\nwas under challenge, whether a petition under Article 226 of the<br \/>\nConstitution would be maintainable or a petition under Article 227 of<br \/>\nthe Constitution would be maintainable, is the question.  To make<br \/>\nthis appeal maintainable under Clause 15 of the Letters Patent, the<br \/>\nappellant would have to show that the petition was under Article 226<br \/>\nof the Constitution and the powers exercised by the learned Single<br \/>\nJudge were also under Article 226 of the Constitution.  We are afraid<br \/>\nthat this is not the position, because no relief under Article 226<br \/>\ncould have been granted by the learned Single Judge in the absence of<br \/>\nTribunal being a party.  The position of law is now made very clear<br \/>\nby the Full Bench of this High Court in the case of Bhagyodaya<br \/>\nCo-operative Bank Ltd. Vs. Natvarlal K. Patel (SCA No. 12382 of 2010<br \/>\nwith SCA No. 15308 of 2010) decided on 28.7.2011, wherein the Full<br \/>\nBench held as under:-\n<\/p>\n<p>&#8220;15. \tFrom<br \/>\nthe aforesaid decisions rendered by this Court and the Supreme Court,<br \/>\nas referred to above, we hold as follows :-\n<\/p>\n<p>(i)\tIn a<br \/>\npetition for relief under Article 226 of Constitution of India<br \/>\nagainst any judgment or award passed by the Industrial Tribunal or<br \/>\nLabour Court, such Industrial Tribunal or Labour Court is a necessary<br \/>\nparty. In absence of such necessary party, no rule and writ can be<br \/>\nissued under Article 226 against such Industrial Tribunal or the<br \/>\nLabour Court, and<\/p>\n<p>(ii)\tBut if a<br \/>\npetition for relief is filed under Article 227 of the Constitution of<br \/>\nIndia, the Court or the Tribunal whose order is impugned in the<br \/>\npetition, is not a necessary party to such petition under Article 227<br \/>\nof the Constitution of India. The High Court can exercise the power<br \/>\nunder Article 227 even in absence of such Court or the Tribunal.\n<\/p>\n<p>\tEven<br \/>\nif it is presumed that the petition was under Article 227 of the<br \/>\nConstitution, then in that case the appeal under Clause 15 would not<br \/>\nbe maintainable.  In this view of the matter, the appeal is dismissed<br \/>\nas being not maintainable, with no order as to costs.\n<\/p>\n<p>\t\t\t\t\t\t(A.L.\n<\/p>\n<p>Dave, Actg.
