DAVE\n\t\t\n\t\n\n \n\nDate\n: 19\/07\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition under Article 226 and 227 of the Constitution is filed<br \/>\nagainst the order dated 12.4.2010 passed by learned Additional Civil<br \/>\nJudge, Devgadh Baria, below application Exh.78, by which, the prayer<br \/>\nof the plaintiff under Order VI Rule 17 came to be rejected on the<br \/>\nground that the amendment was belated and besides when the cause of<br \/>\naction for amending the suit arose was not stated.  Further in view<br \/>\nof proviso Order VI Rule 17, the learned Judge has found that there<br \/>\nwas no justification in granting the prayer of amending the suit and,<br \/>\ntherefore, such an order passed by learned Judge in a Regular Civil<br \/>\nSuit No.69 of 2003 cannot be said to be in any manner contrary to law<br \/>\nwhich deserves any interference in exercising powers under Article<br \/>\n226 and 227 of the Constitution of India.\n<\/p>\n<p>\tHowever,<br \/>\nthat rejection of this petition under Article 226 and 227 of the<br \/>\nConstitution of India shall not be a bar for the petitioner to take a<br \/>\nmeasure in accordance with law.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid, this petition stands disposed of.\n<\/p>\n<p>[ANANT<br \/>\nS.
