This appeal has been<br \/>\nfiled on the point of quantum.  Respondent appellant has also filed<br \/>\nappeal because lessor multiplier has been used.\n<\/p>\n<p>2.\t\tThe<br \/>\nfollowing are submissions in support of the appeal:\n<\/p>\n<p>2.1.\t\tDeceased<br \/>\n Vijaykumar Kantilal Chokshi was aged about 32 years old doing<br \/>\nbusiness at shop situated at Agricultural Produce Market Committee&#8217;s<br \/>\n(A.P.M.C.), Unjha  and as per the evidence- certificate of A.P.M.C.<br \/>\nand local tax receipts, it appears that the said shop was in joint<br \/>\nname of deceased as well as his younger brother namely Biren and as<br \/>\nper deposition and cross-examination of claimant No.4- Kantilal<br \/>\nChokshi- father of deceased (Exh.38),  said  business was started<br \/>\nwith investment made by deceased as well as his younger  son- Biren<br \/>\nin equal share, i.e. 50%  each and to avoid  technicalities in Sales<br \/>\nTax &amp; Income Tax,  deceased as well as his younger  brother&#8217;s<br \/>\nname was mentioned in Exhibits 48 to 53- local tax receipts.<br \/>\nTherefore,  considering these evidence as a whole,  though  income<br \/>\ntax  return was filed by deceased being proprietor of M\/s. Chokshi<br \/>\nVinaykumar Kantilal but profit\/income of said firm was shared between<br \/>\ntwo brothers, so the Tribunal has  totally overlooked this aspect of<br \/>\nmatter and considered the income  shown in I.T. returns as if  income<br \/>\nof deceased  alone. It appears from the evidence that the deceased<br \/>\nundergraduate.  As per the evidence of claimant No.4-father, it<br \/>\nfurther appears that after death of deceased,  his younger brother<br \/>\nhas continued the business at said shop and widow-claimant No.1 was<br \/>\ngiven the share of her husband out of the said business, if it be  so<br \/>\n then  such amount may be required to be deducted  from overall<br \/>\ncompensation.\n<\/p>\n<p>2.2.\t\tThe<br \/>\nTribunal has considered the income of deceased on higher side and<br \/>\nwhen the Tribunal in its impugned judgment at para 12 has recorded<br \/>\nthat income of deceased was increasing as well as decreasing  as in<br \/>\nbusiness,  there  are  ups and down then it ought to have considered<br \/>\nthe average income of last three years of deceased while computing<br \/>\ncompensation that too after deducting 50% share of his younger<br \/>\nbrother from profit of the said firm.\n<\/p>\n<p>2.3.\n<\/p>\n<p>The Tribunal has applied multiplier of 16  which is on higher  side<br \/>\nand considering the recent law  laid down by Hon&#8217;ble Apex Court in<br \/>\nthe following cases,  the learned Tribunal ought  not to have applied<br \/>\n more than 13 multiplier.  In all, the Tribunal has awarded<br \/>\nRs.16,10,672\/-  under the head  of  loss of dependency which is much<br \/>\non higher side,  even if  for time being considering the annual datum<br \/>\nfigure (multiplicand)  arrived at by the Tribunal, i.e.<br \/>\nRs.1,00,667\/-, then if the compensation amount is invested  in FDR,<br \/>\nwhich fetch average interest at the rate of 9% as awarded by the<br \/>\nTribunal, then total annual interest on such FDR  comes to<br \/>\nRs.1,44,960\/-, which is much more than datum figure considered by the<br \/>\nTribunal.  As per the law  laid down by the Hon&#8217;ble Apex  Court in<br \/>\nthe following cases, a compensation- capital sum should also be<br \/>\nconsumed- up over the period for which the dependency is expected  to<br \/>\nlast, which capital  sum in the present case not  consumed-up<br \/>\nbecause of higher interest income received by claimants than<br \/>\nmultiplicand. The following decisions  are  relied upon in support of<br \/>\nthe case:\n<\/p>\n<p>\t1.\t2005<br \/>\n(6) SCC 236  T.N. State Transport Corporation \t\tLtd. \tVs. S.<br \/>\nRajapriya;\n<\/p>\n<p>\t2.\t2005<br \/>\n(8) SCC 473 Managing Director, TNSTC Ltd. \t\tVs. K.I. Bindu;\n<\/p>\n<p>\t3.\t2007<br \/>\n(3) SCC 538 New India Assurance Company \t\tLtd. Vs. Kalpna (SMT);\n<\/p>\n<p>\t4.\t2007<br \/>\nACJ 1076 (SC) Managing Director, TNSTC Ltd. \t\tVs. Sripriya;\n<\/p>\n<p>\t5.\t2008<br \/>\n(2) SCALE 474, The Oriental Insurance\t\t\tCompany Ltd. Vs. Jashuben.\n<\/p>\n<p>3.\t\tWhat<br \/>\nis  foremost  in this case is that the evidence of the claimant has<br \/>\nbeen accepted by the  Tribunal on the question of the income of the<br \/>\ndeceased. No evidence was led by the appellant Insurance Company<br \/>\nbefore the Tribunal, though it had permission to defend.\n<\/p>\n<p>4.\t\tIn<br \/>\nthis case, there was only evidence of the claimant on oath. There was<br \/>\nno rebuttal evidence.  When the Tribunal was not faced with any<br \/>\nrebuttal evidence  then,  there was only one evidence of the<br \/>\nclaimant. An evidence  on oath can only be discarded if there is some<br \/>\nother evidence.  In absence of any other evidence, it can only be<br \/>\ndiscarded  if  it  suffers of patent  defects of such improbabilities<br \/>\n which are  not  liable to be reconciled.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe instant case, the claimant has given justifiable  reasons  for<br \/>\nthe acceptance of  the income of the deceased.  It  had the advantage<br \/>\nof watching the demeanor of the witnesses.  There being no rebuttal,<br \/>\nthe  evidence  if accepted  does not call for  interference.  No<br \/>\nsuch factor  has been indicated  which makes the evidence inherently<br \/>\nimprobable or  impossible to believe.\n<\/p>\n<p>6.\t\tAs<br \/>\n regards  the case of the claimants,  the appellant  suffice it  to<br \/>\nsay that  the multiplier  applied  has  sufficient  indication of the<br \/>\nthought  given by the Tribunal to the factors  involved.  It  cannot<br \/>\nbe  said that  wrong  multiplier has been applied in the facts<br \/>\nrelevant for the case.  In the background discussed hereinabove, the<br \/>\nappeal  deserves  to be  dismissed.
