Justice ANTONY DOMINIC\n\n Dated :19\/03\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J.\n              ------------------------------------\n                        W.P.(C) 9421 of 2008\n             -------------------------------------\n                       Dated: MARCH 19, 2008\n\n                             JUDGMENT\n<\/pre>\n<p>      Non-payment of compensation awarded by the Tribunal in<\/p>\n<p>Ext.P1 award is the grievance of the petitioner.<\/p>\n<p>      2. The award has been rendered by the MACT, Ernakulam in<\/p>\n<p>O.P.(MV) 40\/1998. Even according to the respondents there is no<\/p>\n<p>dispute that the award has not become final. The only justification<\/p>\n<p>of financial constraints cannot be a justification to avoid payment.<\/p>\n<p>      Accordingly I do not find any justification for the inordinate<\/p>\n<p>delay already caused and hence this writ petition is disposed of<\/p>\n<p>directing that the respondents shall deposit the amount of<\/p>\n<p>compensation ordered in Ext.P1 award as expeditiously as possible,<\/p>\n<p>at any rate, within three months of production of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<\/p>\n<p>                                            ANTONY DOMINIC, JUDGE<br \/>\nmt\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.C.Bright vs The Managing Director on 19 March, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 9421 of 2008(V) 1.
