No.661 of 2005\n          ------------------------------------------------\n           Dated this the 29th day of May, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>    This appeal is posted at Bench today as<\/p>\n<p>steps are not taken for notice being issued to<\/p>\n<p>respondents 2, 5 and 6 on C.M. Application<\/p>\n<p>No.429\/05 seeking condonation of delay of as<\/p>\n<p>much as 294 days in filing the appeal. The<\/p>\n<p>judgment under appeal was passed on 10\/04\/03<\/p>\n<p>and this appeal is filed after more than two<\/p>\n<p>years on 16\/05\/05. Application for copy of<\/p>\n<p>judgment is seen filed on 22\/04\/03 and the<\/p>\n<p>date notified to receive copy was 06\/05\/04.<\/p>\n<p>According  to     the       appellant\/petitioner,            the<\/p>\n<p>appeal should have been filed on or before<\/p>\n<p>24\/07\/04, but could be filed only on 16\/05\/05.<\/p>\n<p>For the delay of 294 days in filing the<\/p>\n<p>appeal, the reason stated by the appellant in<\/p>\n<p>the affidavit filed by him in support of C.M.<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.661 of 2005           -2-<\/span><\/p>\n<p>        Application       No.429\/05  is that soon  after<\/p>\n<p>        receipt of copy of judgment appealed against,<\/p>\n<p>        the clerk attached to the office of the lawyer<\/p>\n<p>        sent letter intimating that copy has been<\/p>\n<p>        received, but the letter was not received by<\/p>\n<p>        him and he was under the impression that he<\/p>\n<p>        will be intimated on receipt of copy and that<\/p>\n<p>        he went over to the office of the lawyer and<\/p>\n<p>        made enquiries on 16\/04\/05 as he did not get<\/p>\n<p>        any intimation and only then could he know<\/p>\n<p>        that copy was received long back and a letter<\/p>\n<p>        was sent to him. It is his further case that<\/p>\n<p>        as the courts were closed for summer holidays<\/p>\n<p>        the appeal was filed only on the reopening of<\/p>\n<p>        courts. In short, the appellant is attributing<\/p>\n<p>        reasons for delay to non-receipt of letter<\/p>\n<p>        issued by the lawyer&#8217;s clerk to him. The said<\/p>\n<p>        averment is not supported by the lawyer&#8217;s<\/p>\n<p>        clerk        and the affidavit is  filed by  the<\/p>\n<p>        appellant behind the back of his lawyer&#8217;s<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.661 of 2005            -3-<\/span><\/p>\n<p>        clerk. Assigning some reason or the other is<\/p>\n<p>        no ground to have delay of 294 days condoned<\/p>\n<p>        and to have the appeal received on file. There<\/p>\n<p>        is      no     meaning   in   retaining   the   C.M.<\/p>\n<p>        Application on file after three years of its<\/p>\n<p>        filing especially when no steps are taken to<\/p>\n<p>        complete        service on  the  delay   condonation<\/p>\n<p>        application. The request made by the counsel<\/p>\n<p>        for more time to complete service of notice on<\/p>\n<p>        the delay condonation application does not<\/p>\n<p>        deserve any consideration in the circumstances<\/p>\n<p>        in which the delay of 294 days has been caused<\/p>\n<p>        in filing the appeal and there is no just and<\/p>\n<p>        sufficient cause to condone the said delay.<\/p>\n<p>                In     the  result,  I  dismiss  this   C.M.<\/p>\n<p>        Application.
