S.C.No.59\/2003 and convicting the appeliant\/accused for the

\nSection 397 and also under Section 302 of IPC and sentencing

M.Os.7′ to 9 were seized under mahazar. The accused is<\/p>\n
prosecuted for committing the offence U \/ Ss.392, 397 & 302 IPC.<\/p>\n

that the accused following her.\u00bb ‘They ‘fouild accused<\/p>\n
coming from Shantinagar area at 5V.\u00bb3l0;p:,:n. He Was;<\/p>\n
looking confused “‘gand his  were
\nbioodstained, 3  0  it 3<\/p>\n
The PW10  to the recovery of
\nM.Os.’? to 9. He thehlprjosecution case. PW3<\/p>\n

\n_belongi*ng to  ‘ cl eceased.\n<\/p>\n
 The 113. “p_a’1’1;’h witness to the recovery of the<\/p>\n
blood .stfainedl’*~clothes M.Os.16 and 17 and knife<\/p>\n
 M.Oi18 .supports the seizure under mahazar Ex.P.8.<\/p>\n
 ESL and the Serologist report discloses that, the<\/p>\n
W,,_Lhbloodi_j.stains on the clothing of the accused, Knife<\/p>\n
0 ‘aindeilon the clothing of the deceased are of ‘A’ group<\/p>\n
  pg blood.\n<\/p>\n
.0 The Post Inortem report discloses that death is due<\/p>\n
to massive haemorrhage and shock due to cut of left
\ncarotid artery. The death is homicidal.<\/p>\n
The prosecution explains that the injuries on the
\naccused is because of the scuttle at the time of
\nrobbery and murder. The injuries on the accused<\/p>\n
are simple in nature as per wound certificate Ex.P-4.<\/p>\n
The Trial Court on the basis of the above circumstances
\nconvicted the accused for the offence punishable U \/ Ss. <\/p>\n
and 302 IPC. The accused is in appeal.<\/p>\n
5. The counsel for the accused appel_lant’_:’strenuously  <\/p>\n

  prove the guilt of the accused:<\/p>\n

\nif if and PW6 that accused closely following the
\ndeceased towards Shanthinagar area and about an<\/p>\n
hour thereafter accused alone coming out from
\nShanthinagar area looking confused, tensed and<\/p>\n
his clothing blood stained,<\/p>\n

\nPWIO and PW3.\n<\/p>\n

with the blood group of the deceeeedf .’   ‘
