GOVERNMENT PLEADER for Respondent(s)\n: 2, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE D.A.MEHTA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MS.JUSTICE H.N.DEVANI)<\/p>\n<p>By<br \/>\n\tthis petition under Article 226 of the Constitution of India the<br \/>\n\tpetitioners challenge the demand raised vide bill dated 4th<br \/>\n\tDecember 2009 for Rs.1,65,000\/-  towards installation charges and<br \/>\n\tannual fees  for the Mobile Tower of the petitioners in the area of<br \/>\n\tthe respondent No.1 municipality.\n<\/p>\n<p>The<br \/>\n\tlearned Senior Advocate appearing for the petitioner has invited<br \/>\n\tattention to the bill dated 4th<br \/>\n\tDecember 2009, to point out that the same has been issued pursuant<br \/>\n\tto amended resolution No. NPL\/4508\/5427\/M dated 28.11.2009 issued by<br \/>\n\tthe Government<br \/>\n\tof Gujarat, Urban Development and Urban Housing Department. It is<br \/>\n\tsubmitted that the said Government Resolution dated 28.11.2009 was<br \/>\n\tsubject matter of challenge before this Court and this Court vide<br \/>\n\torder dated 22nd<br \/>\n\tApril 2010 made in Special Civil Application NO.157 of 2010, has<br \/>\n\tquashed the said resolution.\n<\/p>\n<p>Despite<br \/>\n\tservice of rule, there is no appearance on behalf of the respondent<br \/>\n\tNo.1 municipality.\n<\/p>\n<p>It<br \/>\n\tis an accepted position that the controversy involved in the present<br \/>\n\tpetition stands concluded vide judgment and order dated 22nd<br \/>\n\tApril 2010 made in Special Civil Application No.157 of 2010 whereby<br \/>\n\tthe resolution No. NPL\/4508\/5427\/M dated 28.11.2009 issued by the<br \/>\n\tGovernment of Gujarat, Urban Development and Urban Housing<br \/>\n\tDepartment has been quashed and set aside. In the said case, this<br \/>\n\tCourt has followed its decision in the case of <a href=\"\/doc\/63840779\/\">Indus<br \/>\n\tTowers Ltd. v. State of Gujarat and others<\/a>,<br \/>\n\trendered on 22nd<br \/>\n\tApril 2010 in Special Civil Application No.1898 of 2009 and other<br \/>\n\tcognate matters, whereby the Resolution dated 11th<br \/>\n\tDecember 2008 issued<br \/>\n\tby the Government of Gujarat, Urban Development and Urban Housing<br \/>\n\tDepartment, providing for levy and recovery of Annual Permission<br \/>\n\tFees and Installation Charges on mobile telecommunication towers in<br \/>\n\tthe areas covered under Municipal Corporations\/Municipalities in the<br \/>\n\tState of Gujarat<br \/>\n\thas been struck down as being ultra vires the provisions of Article<br \/>\n\t265 of the Constitution of India as well<br \/>\n\tas ultra vires the provisions  of the Bombay Provincial Municipal<br \/>\n\tCorporation Act, 1949 and the Gujarat Municipalities Act, 1963.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, in the light of the order dated 22.04.2010 made<br \/>\n\tin Special Civil Application No.157 of 2010, when the Government<br \/>\n\tResolution which forms the basis of the demand in the present case<br \/>\n\thas been set aside the demand cannot be sustained.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons the petition succeeds and is accordingly<br \/>\n\tallowed. The impugned demand notice dated 4th<br \/>\n\tDecember 2009 (Annexure  A  to the petition) is hereby quashed<br \/>\n\tand set aside.  Rule is made absolute accordingly.\n<\/p>\n<p>Vide<br \/>\n\torder dated 26th<br \/>\n\tFebruary 2010, this Court had directed the petitioner to deposit 20%<br \/>\n\tof the amount mentioned in the impugned communication produced at<br \/>\n\tAnnexure  A  to the petition.
