    First defendant in O.S.122\/1995 on the file of<\/p>\n
Munsiff Court, Ranny is the appellant.        First<\/p>\n
respondent is the plaintiff.  Second defendant   is<\/p>\n
the third defendant.   Second respondent died when<\/p>\n
the suit was pending before the trial court.  First<\/p>\n
respondent instituted the suit seeking a decree for<\/p>\n
declaration  of   title   and   for   recovery   of<\/p>\n
possession.  Case of  first respondent was that the<\/p>\n
plaint schedule property belong to her under Ext.A1<\/p>\n
settlement  deed  executed  by  her  husband,   the<\/p>\n
appellant,  and  she  obtained  possession  of  the<\/p>\n
property on the date of Ext.A1 and since then she<\/p>\n
has been in possession of the property and while so<\/p>\n
in June 1990 appellant had gone abroad and the<\/p>\n
father of the first respondent constructed the<\/p>\n
building for her and still due to  the interference<\/p>\n
of the relatives of the appellant, she could not<\/p>\n

continue to live there and      she was compelled to<\/p>\n
leave the residence and      live with her father and<\/p>\n
in    1990    appellant returned  back,  but  due  to<\/p>\n
difference of opinion between them he deserted her<\/p>\n
and         second defendant mother was only having<\/p>\n
nominal right in the property.       It was contended<\/p>\n
that after          first respondent started residing<\/p>\n
with her father in 1990,         appellant and other<\/p>\n
respondents trespassed into the plaint schedule<\/p>\n
property and reduced it into their possession and<\/p>\n
though appellant cancelled Ext.A1 under Ext.B2, it<\/p>\n
is not valid and under Ext.B2 appellant did not<\/p>\n
derive any right and     first respondent is therefore<\/p>\n
entitled to a declaration of title as well as<\/p>\n
decree for       recovery of possession.    Appellant<\/p>\n
along with the deceased second defendant filed a<\/p>\n
joint      written  statement  admitting  that  first<\/p>\n
respondent was his wife.       It was contended that<\/p>\n
after the marriage at different periods between<\/p>\n
1983 to 1990 appellant was abroad and during that<\/p>\n

period till 1989 first respondent was residing<\/p>\n
along      with    second  defendant  and  family  and<\/p>\n
thereafter      building was constructed in the plaint<\/p>\n
schedule      property  by  the  appellant and   under<\/p>\n
Ext.A4 settlement deed appellant has title to the<\/p>\n
plaint schedule property subject to the life intent<\/p>\n
of second defendant and Ext.A1 settlement deed in<\/p>\n
favour of first respondent happened to be executed<\/p>\n
as he was under the belief that she will live with<\/p>\n
him     and    though  Ext.A1   was  executed,   first<\/p>\n
respondent      did  not  obtain  possession  of   the<\/p>\n
property and Ext.A1 did not come into effect and on<\/p>\n
25.11.1990 when appellant returned back from abroad<\/p>\n
first respondent and the child was not seen in the<\/p>\n
house and appellant came to know that on 7.1.1990<\/p>\n
she had gone along with neighbour Achankunju and is<\/p>\n
living with him as husband and wife and therefore<\/p>\n
on 12.9.1990 appellant complained to Sub Inspector<\/p>\n
of Police, Ranny and Circle Inspector of Police and<\/p>\n
appellant      came to know that the relationship was<\/p>\n

broken and he executed Ext.B2 cancellation deed and<\/p>\n
thereafter       he filed O.P.(divorce) 9\/94 and for<\/p>\n
custody of the child O.P.(G & W) No.13\/91 and as<\/p>\n
Ext.A1      was cancelled    by  executing  Ext.B2  on<\/p>\n
22.6.1991,      first respondent has no title to the<\/p>\n
property and she is not entitled to the decree for<\/p>\n
declaration or recovery of possession sought for.<\/p>\n
Learned Munsiff on the evidence of Pws.1 to 3,<\/p>\n
Dws.1 to 4, Exts.A1 to A4 and Exts.B1 to B4 granted<\/p>\n
a decree for declaration of title and recovery of<\/p>\n
possession.       Appellant challenged the decree and<\/p>\n
judgment before District Court, Pathanamthitta in<\/p>\n
A.S.93\/98.             Learned   District   Judge   on<\/p>\n
reappreciation of evidence confirmed the findings<\/p>\n
of learned Munsiff and dismissed the      appeal.   It<\/p>\n
is challenged in the second appeal.<\/p>\n
      2.   Learned counsel appearing for appellant was<\/p>\n
heard.\n<\/p>\n
      3.     The argument of learned counsel appearing<\/p>\n
for appellant is that Ext.A1 is not a gift deed as<\/p>\n

interpreted by the courts below, but is only a<\/p>\n
settlement deed as provided under section 2 (q) of<\/p>\n
Kerala Stamp Act and as        first respondent eloped<\/p>\n
with      a neighbour and did not fulfil the hopes of<\/p>\n
appellant,      he  was  compelled  to execute  Ext.B2<\/p>\n
cancellation deed and therefore under Ext.A1 first<\/p>\n
respondent cannot claim any title to the property.<\/p>\n
It was argued that courts below should have found<\/p>\n
on the evidence that Ext.A1 settlement deed did not<\/p>\n
come     into   effect  and  was  not acted  upon  and<\/p>\n
accepted      and  first  respondent  did  not  obtain<\/p>\n
possession of the property at all and therefore<\/p>\n
findings of the courts below are to be set aside.<\/p>\n
      4.     On hearing the learned counsel I do not<\/p>\n
find any substantial question of law involved in<\/p>\n
the appeal.\n<\/p>\n
      5.     Though it was argued that Ext.A1 is not a<\/p>\n
gift deed, except the nomenclature of the     document<\/p>\n
as a settlement deed, it is an outright gift deed,<\/p>\n
as rightly found by the courts below.          Learned<\/p>\n
R.S.A.872\/2006             6<\/span><\/p>\n
Munsiff and learned District Judge on appreciation<\/p>\n
of evidence, found that Ext.A1 gift deed was acted<\/p>\n
upon and accepted.     That factual finding cannot be<\/p>\n
interfered     by  reappreciating  the  evidence   in<\/p>\n
exercise of the powers of this court under section<\/p>\n
100 of CPC.     Once   Ext.A1 gift deed was accepted<\/p>\n
and acted upon, by executing Ext.B2, the gift deed<\/p>\n
cannot      be cancelled  and  by  such  cancellation<\/p>\n
appellant is not entitled to dispute the    title of<\/p>\n
the first respondent or claim any title.     In such<\/p>\n
circumstance, I find no reason to interfere with<\/p>\n
the    decree  and  judgment  of  the  courts  below.<\/p>\n
Appeal is dismissed.\n<\/p>\n
      Learned counsel appearing for appellant then<\/p>\n
argued that first appellant court did not rule out<\/p>\n
the possibility of the construction of the building<\/p>\n
in the plaint schedule property, at the expense of<\/p>\n
the appellant and therefore appellant is to be<\/p>\n
granted liberty to realise the amount so spent.    It<\/p>\n
is made clear that if appellant has constructed the<\/p>\n

building      or contributed     the   amount   for<\/p>\n
construction of the building, the decree granted in<\/p>\n
suit will not bar     appellant from claiming   the<\/p>\n
