She has further stated that the<br \/>\noriginal complainant is also present before the Court. He also<br \/>\nsupports the quashing petition and has filed an affidavit before the<br \/>\ntrial Court, which is produced at Page-33 of the compilation.\n<\/p>\n<p>2.\t\tOn the above basis,<br \/>\nthe petitioners seek quashing of the complaint at  Annexure-A ,<br \/>\nbearing Criminal Case No.31 of 2009, dated 08.04.2009, filed before<br \/>\nthe learned Chief Judicial Magistrate, Amreli and M. Case No.9\/09,<br \/>\ndated 15.04.2009, filed before Amreli City Police Station, for the<br \/>\noffences punishable under Sections 406, 420, 504, 506(2) read with<br \/>\nSection 114 of the Indian Penal Code.\n<\/p>\n<p>3.\t\tBy order dated<br \/>\n21.01.2010, passed in Criminal Miscellaneous Application No. 11085 of<br \/>\n2009, the prayer for quashing was accepted, making following<br \/>\nobservations:\n<\/p>\n<p> Rule.  Learned APP<br \/>\nMs. Shah waives service of rule on behalf of respondent No.2 and Mr.<br \/>\nRJ Patel for Mr.TR Savani waives service of rule on behalf of<br \/>\nrespondent No.1.\n<\/p>\n<p>\tPetitioners seek<br \/>\nquashing of complaint at annexure A filed by respondent No.1 herein.<br \/>\nThe said complaint was filed before the learned Magistrate alleging<br \/>\ncommission of offence  punishable under sections 406, 408, 420 etc.<br \/>\nread with section 114 of the Indian Penal Code.\n<\/p>\n<p>\tCounsel for the parties<br \/>\n submit that the issues have been resolved between the parties.  A<br \/>\ncopy of the affidavit dated 1.7.09 filed  before the learned<br \/>\nMagistrate is also produced on record. In the said affidavit, the<br \/>\ncomplainant has stated, inter alia,  that he had filed the complaint<br \/>\nout of some misunderstanding. However, with the intervention of the<br \/>\nelders of the family, misunderstanding has been removed and he<br \/>\ntherefore does not want proceed with the complaint.  Apparently,  in<br \/>\nthe meantime the charge has also been filed.\n<\/p>\n<p>\tSince the allegations<br \/>\nare pertaining to internal disputes between the complainant and the<br \/>\npetitioners, in view of the compromise between the parties, I see no<br \/>\npossibility of recording any conviction. No useful purpose will be<br \/>\nserved in proceeding further with the complaint and the trial arising<br \/>\nout of the same.  However, the complainant had apparently filed the<br \/>\ncomplaint and shortly thereafter withdrew the same presumably on his<br \/>\ndemand being satisfied by the petitioners.  Statement of the<br \/>\ncomplainant that the complaint  was filed on account of some<br \/>\nmisunderstanding and that such misunderstanding has been removed with<br \/>\nthe intervention of the elders cannot be  accepted on its face value.\n<\/p>\n<p>\tIn<br \/>\nthe result, though complaint at Annexure A and the subsequent<br \/>\nproceedings arising therefrom are quashed, respondent No.1 is<br \/>\ndirected to pay Rs.10,000\/- (Rupees ten thousand only) to the State<br \/>\nby way of costs.\n<\/p>\n<p>4.\t\tIn this petition,<br \/>\nthe request being similar, the prayer for quashing is accepted,<br \/>\nsubject to the condition that the petitioners and the original<br \/>\ncomplainant shall jointly deposit Rs.10,000\/-, with the State<br \/>\nLegal Services Authority, within a period of TWO WEEKS,<br \/>\nfrom today.  The complaint at  Annexure-A , bearing<br \/>\nCriminal Case No.31 of 2009, dated 08.04.2009, filed before the<br \/>\nlearned Chief Judicial Magistrate, Amreli and M. Case No.9\/09, dated<br \/>\n15.04.2009, filed before Amreli City Police Station, are QUASHED.<br \/>\nThe office shall place the matter before the Court, if the accused do<br \/>\nnot deposit the same before the Court.
