The present<br \/>\napplication has been preferred for regular bail under section 439 of<br \/>\nthe Code of Criminal Procedure in connection with  the offence<br \/>\nregistered as Cr. No. I-58 of 2006 with Khambhat city police station<br \/>\nfor the offences punishable under sections 465, 467, 468, 471, 420<br \/>\nand 120-B of the Indian Penal Code.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard the learned advocates for both the sides and looking to the<br \/>\nfacts and circumstances, statements of witnesses, gravity of the<br \/>\noffence, quantum of punishment, the manner in which the applicant is<br \/>\ninvolved in the offence, as per the allegations of the prosecution,<br \/>\ncoupled with the fact that now investigation is over and charge-sheet<br \/>\nis already filed, and there is no antecedent of the present<br \/>\napplicant, this  application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with Crime Register No.I-58 of 2005<br \/>\nof Khambhat city Police station on his  executing a bond of Rs.<br \/>\n5000\/- (Rs. Five thousand) with one surety of the like amount to the<br \/>\nsatisfaction of the lower Court and subject to the conditions that he<br \/>\nshall:\n<\/p>\n<p>(a)<br \/>\n  not take undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>(b)<br \/>\n   not act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>\u00a9<br \/>\n     maintain law and order;\n<\/p>\n<p>(d)<br \/>\n   mark his presence before Khambhat city police station on every<br \/>\nfirst day of English calendar month between 9.00 a.m. to 2.00 p.m.;\n<\/p>\n<p>(e)<br \/>\n  not leave the state of Gujarat without the prior permission of the<br \/>\nSessions Court  concerned;\n<\/p>\n<p>(f)<br \/>\n   furnish the address of his residence at \tthe time of execution of<br \/>\nthe bond and shall \tnot change the residence without prior permission<br \/>\nof this Court;\n<\/p>\n<p>(g)<br \/>\n    surrender his passport, if any, to the lower court within a week.\n<\/p>\n<p>3.\t\tIn<br \/>\ncase of breach of any of the above conditions, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or to take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbond before the lower court having jurisdiction to try the case.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
