Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/07\/2009\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.2146 of 2009\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p>    This petition is filed under Section 482 of Code<\/p>\n<p>of Criminal Procedure for a direction to the first<\/p>\n<p>respondent to consider Annexure-A2 representation made<\/p>\n<p>before the Chief Minister, with copies to the Home<\/p>\n<p>Minister, the Home Secretary and Superintendent of<\/p>\n<p>Police,  Kannur.  Case  of   the  petitioner  is   that<\/p>\n<p>regarding the death of Ajitha on 6.6.2006, Payyannur<\/p>\n<p>Police registered a crime and during investigation,<\/p>\n<p>petitioner was questioned and while questioning, he was<\/p>\n<p>tortured and police men also allowed the relatives of<\/p>\n<p>late  Ajitha  to  manhandle   him  and  on   24.4.2009,<\/p>\n<p>petitioner was asked to get into the police vehicle and<\/p>\n<p>when the police vehicle was stopped at a deserted<\/p>\n<p>place, a Tata Sumo Van bearing Reg.No.KL-13\/K 1229 came<\/p>\n<p>there and two persons came out and thereafter the<\/p>\n<p>police men told the petitioner that those persons will<\/p>\n<p>drop him in his house and reluctantly, petitioner got<\/p>\n<p>into the van and he was thereafter brutally beaten by<\/p>\n<p><span class=\"hidden_text\">CRMC 2146\/09               2<\/span><\/p>\n<p>those persons and he was kept in detention for two days<\/p>\n<p>and after two days, police men from Ulikkal Police<\/p>\n<p>Station surrounded that house and took the petitioner<\/p>\n<p>into custody and he was tortured in the custody also<\/p>\n<p>and Ulikkal police registered Crime No.82\/2006 for<\/p>\n<p>offences under Sections 365, 323, and 324 read with<\/p>\n<p>Section 149 of Indian Penal Code and subsequently,<\/p>\n<p>after investigation, Annexure-A1 final report was filed<\/p>\n<p>for the said offences. It is the case of the petitioner<\/p>\n<p>that  there   was  a  conspiracy  between  the   second<\/p>\n<p>respondent and he was made an accused in that case and<\/p>\n<p>statement of the petitioner was not recorded during<\/p>\n<p>investigation and therefore, he was compelled to submit<\/p>\n<p>Annexure-A2 representation before the Chief Minister<\/p>\n<p>and it is necessary to pass appropriate orders on<\/p>\n<p>Annexure-A2 representation.\n<\/p>\n<p>    2. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Public Prosecutor were heard.<\/p>\n<p>    3. From the submissions of the learned counsel<\/p>\n<p>appearing   for the   petitioner,  it  is  clear   that<\/p>\n<p>grievance    of  the   petitioner   is   against    the<\/p>\n<p>investigation and Annexure-A1 final report.  As held by<\/p>\n<p><span class=\"hidden_text\">CRMC 2146\/09               3<\/span><\/p>\n<p>the Apex Court in <a href=\"\/doc\/1836621\/\">Sakiri Vasu v. State of U.P.<\/a> (2008<\/p>\n<p>(1) KLT 724(SC)), the remedy of the petitioner is to<\/p>\n<p>approach the Magistrate under Section 156(3) of Code of<\/p>\n<p>Criminal Procedure.   If the case of the petitioner is<\/p>\n<p>that second respondent should also be an accused, he is<\/p>\n<p>at liberty to file a private complaint.
