RAM KUNWAR, SON OF RAM AYODHYA SINGH\n                                   Versus\n                            STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>2.   14.6.2010             Heard learned counsel for the petitioners and the State.<\/p>\n<p>                           The petitioners seek anticipatory bail in a case instituted for<\/p>\n<p>                 the offence under section 302\/34 of the Indian Penal Code.<\/p>\n<p>                           Even though the allegation in the First Information Report is<\/p>\n<p>                 that the daughter of the informant, who was married in 1999, was<\/p>\n<p>                 done to death by her in-laws in January 2008, but there are documents<\/p>\n<p>                 to suggest that in fact the deceased has died on account of accidental<\/p>\n<p>                 fire in the house, in which transaction even the husband of the<\/p>\n<p>                 deceased and his uncle sustained burn injuries. After the death of the<\/p>\n<p>                 deceased, her death certificate was also granted by the authorities and<\/p>\n<p>                 she was cremated according to Hindu Rites.\n<\/p>\n<p>                           In view of such, in the event of surrender of the petitioners,<\/p>\n<p>                 named above, who are the father in law and the brother in law of the<\/p>\n<p>                 deceased respectively within four weeks from today in connection<\/p>\n<p>                 with Naubatpur P.S. Case No. 33 of 2008 they shall be released on<\/p>\n<p>                 anticipatory bail on furnishing bail bonds of Rs. 5,000\/- (five<\/p>\n<p>                 thousand) each two sureties of the like amount each to the satisfaction<\/p>\n<p>                 of the Addl. Chief Judicial Magistrate, Danapur, subject to the<\/p>\n<p>                 conditions as laid down under Section 438 (2) Cr.P.C. and (i) that one<\/p>\n<p>                 of the bailors will be a close relative of the petitioners, who will give<\/p>\n<p>                 an affidavit giving genealogy as to how he is related with the<br \/>\n<span class=\"hidden_text\">                                         -2-<\/span><\/p>\n<p>                 petitioners. The bailors will undertake to furnish information to the<\/p>\n<p>                 court about any change in the address of the petitioners, (ii) that the<\/p>\n<p>                 petitioners shall undertake to be represented on the first date after<\/p>\n<p>                 cognizance and in case they fail to do so, their bail bond shall be liable<\/p>\n<p>                 to be cancelled, (iii) that the petitioners will give an undertaking that<\/p>\n<p>                 they will receive the police papers on the given date and be present on<\/p>\n<p>                 the date fixed for charge and if they fail to do so on two given dates<\/p>\n<p>                 and delay the trial in any manner, their bail will be liable to be<\/p>\n<p>                 cancelled for reasons of misuse and (iv) that the petitioners will be<\/p>\n<p>                 well represented on each date and if they fail to do so on two<\/p>\n<p>                 consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/Fahad                                ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Ayodhya Singh &amp;Amp; Anr vs State Of Bihar on 14 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
