1.\tThe
\npetitioner seeks bail in connection with FIR dated 8.4.2006 filed
\nbefore Gorva Police Station.  Petitioner is a police officer.
\nAllegations against him pertain to false involvement of one Prakash
\nPillai in narcotic offences.  After completion of investigation
\ncharge sheet came to be filed against the petitioner, who is shown as
\naccused no.3 and other co-accused alleging commission of offences
\npunishable under Sections 8(C), 15, 18, 20, 22 and 29 of the Narcotic
\nDrugs and Psychotropic Substances Act and Section 120 (B), 195, 491,
\n465, 467, 468 and 471 of the Indian Penal Code.\n<\/p>\n
2.\tPreviously
\npetitioner had approached this Court by filing regular bail
\napplication after charge sheet, which bail application being Criminal
\nMisc. Application No.674 of 2009 came to be disposed of an by order
\ndated 10.11.2009 in following terms:\n<\/p>\n
“Dismissed
\nas not pressed. Notice is discharged. It will be open for the
\npetitioner to request the trial court for taking up the trial for
\nearly hearing. When such a request is made, learned Judge shall
\nconsider it depending upon workload of the concerned court.”\n<\/p>\n
3.\tThis
\nfresh bail application is filed mainly on two grounds.  Firstly that
\nthe trial has been stayed by this Court by an order dated 9.4.2010
\npassed in Criminal Revision Application No.217 of 2010 and that
\ntherefore the trial is unlikely to be over shortly.  The second
\nground is that the trial Court has framed charge only under Sections
\n29 and 58 of the NDPS Act, maximum punishment prescribed for which is
\ntwo years.\n<\/p>\n
4.\tTaking
\nme through the documents on record, counsel for the petitioner
\nsubmitted that the petitioner is a police officer, after changing of
\ninvestigating officers and recording of further statements, his
\ninvolvement was revealed in the alleged offence suggesting that bag
\nfull of narcotic (Ganja) was found abandoned behind the bushes near
\nthe house of Prakash Pillai.  Petitioner is sought to be roped in in
\nframing said Prakash Pillai in false narcotic case.  He along with
\nothers have therefore been charge-sheeted as mentioned above.\n<\/p>\n
5.\tCounsel
\nfurther submitted that co-accused one Krishna Somani has been
\nreleased on bail by this Court by an order dated 15.1.2009 passed in
\nCriminal Misc. Application No.16789 of 2008.\n<\/p>\n
6.\tCounsel
\ndrew my attention to Section 436-A of the Criminal Procedure Code to
\ncontend that the petitioner cannot be detained in jail beyond the
\nmaximum period of punishment prescribed for the offences alleged.  He
\nsubmitted that the petitioner is in jail since 29.8.2008 without
\ntrial and being a police officer he is not likely to jump the bail.\n<\/p>\n
7.\tOn
\nthe other hand learned APP opposed the bail application contending
\nthat the petitioner is a police officer found to have been involved
\nin setting up a false case of narcotic against an innocent person.
\nCo-accused Kalubhai Vahoniya was denied bail by this Court by order
\ndated 6.2.2009 passed in Criminal Misc. Application No.15767 of 2008.
\n He further submitted that the charge framed by the trial Court has
\nbeen challenged by said Prakash Pillai and the High Court has stayed
\ntrial.  The charge, therefore, framed by the trial Court has not
\nattained finality.  Learned APP further pointed out that the bail
\ngranted to said Krishna Somani was challenged before the Supreme
\nCourt and thereafter application for cancellation of such order has
\nbeen moved before High Court.\n<\/p>\n
8.\tHaving
\nheard learned advocate for the parties and having perused the
\ndocuments on record, at this stage when the trial is yet to be
\ncompleted, I do not find it appropriate to make any observations on
\nthe nature of evidence on record and the rival contentions regarding
\nthe involvement or lack thereof of the petitioner in the alleged
\noffence.\n<\/p>\n
9.\tWhen
\npreviously the petitioner’s bail application was turned down, as is
\napparent from order dated 10.11.2009, there was some hope and
\nexpectation that the trial would be completed within reasonable
\nperiod.  It was, therefore, that while permitting the petitioner to
\nwithdraw the bail application he was allowed to request the trial
\nCourt for taking up trial on early hearing basis.\n<\/p>\n
10.\tIn
\nview of subsequent development, however, unfortunately this
\nexpectation of completion of trial at an early date would not be
\nfulfilled.  This is so because when the trial Court framed the
\ncharge, the same came to be challenged by the victim and this Court
\nhas stayed entire trial by an order dated 9.4.2009.\n<\/p>\n
11.\tIn
\nthat view of the matter, I have permitted counsel for the petitioner
\nto argue the bail application on merits, though previously bail
\napplication was withdrawn after charge sheet.  Previous bail
\napplication as one can see was withdrawn on 10.11.2009.  After
\nconsiderable gap of time particularly when the possibility of early
\nconclusion of the trial is ruled out, I see no difficulty in
\nexamining the request of the petitioner for bail on merits.  In the
\nmeantime one more factor which has intervened is framing of charge by
\nthe trial Court.\n<\/p>\n
12.\tAs
\nper the charge framed offences alleged are those punishable under
\nSections 29 and 58 of the NDPS Act maximum punishment being two
\nyears.  It is of course true that this Court is examining such order
\nof the trial Court and found prima facie interest to
\nscrutinize the issues closely.  It is therefore that the Court has by
\ngiving brief reasons entertained petition and also stayed the trial.\n<\/p>\n
13.\tThe
\npiquant situation therefore arises is that on one hand the petitioner
\nis in jail since 29.8.2008 with no possibility of an early end to the
\ntrial.  On the other hand, the trial is stayed and it is not clear
\nwhen such stay may be lifted.  Yet another aspect of the matter is
\nthat as per the trial Court at least the material on record suggests
\ninvolvement of the petitioner in offences no more serious than those
\npunishable under Sections 29 and 58 of the NDPS Act.  This aspect of
\nthe matter is being re-examined by High Court, however, such issue is
\nyet to achieve finality.\n<\/p>\n
14.\tIn
\nthe meantime, one more co-accused has been released on bail, of
\ncourse on an additional ground of indifferent health. Fact, however,
\nremains that the petitioner is in jail since 29.8.2008 and the trial
\nis unlikely to be completed soon.\n<\/p>\n
15.\tI
\nnotice that against the bail granted by this Court in the case of
\nKrishna Somani was challenged before the Supreme Court by Shri
\nPrakash Pillai.  However, the same was withdrawn with a liberty to
\napproach the High Court for cancellation of bail.\n<\/p>\n
16.\tConsidering
\nabove aspects of the matter and also considering that the petitioner
\nbeing a government servant is unlikely to jump the bail if released,
\nI am inclined to release him on bail on certain conditions.    I have
\nalso examined that even as per the charge sheet, none of the offences
\nalleged under the NDPS Act are those for which restrictions under
\nSection 37 of the Act for granting regular bail would apply.\n<\/p>\n
17.\tIt
\nis, however, clarified that ultimately if High Court in Criminal
\nRevision Application No.217 of 2010 passes any order, effectively
\nproviding for or requiring a more serious charge, it would be open
\nfor the prosecution to seek cancellation of this order.\n<\/p>\n
18.\tIn
\ntotality of the facts and circumstances, the petitioner is ordered to
\nbe released on bail in connection with C.R.No.II-37 of 2006 of Gorva
\nPolice Station  on furnishing   bond of Rs.1,00,000\/- (Rupees  One
\nLac only) with one surety of the like amount to the satisfaction of
\nthe lower Court and on conditions that he shall :\n<\/p>\n
[a]\tnot
\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n
[b]\tnot
\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n
[c]\tmaintain
\nlaw and order;\n<\/p>\n
[d]\tmark
\nhis presence before the Maninagar Police Station on every 1st
\nand 15th day of English Calender month between  11.00 a.m.
\nAnd 2 p.m .\n<\/p>\n
[e]\tnot
\nleave city of Ahmedabad without permission of the Sessions \tJudge
\nconcerned;\n<\/p>\n
[f]\tfurnish
\nthe address of his residence at the time of execution of the \tbond
\nand shall not change the residence without prior permission \tof  this
\nCourt;\n<\/p>\n
[g]\tsurrender
\nhis passport, if any, to the Lower Court immediately.\n<\/p>\n
19.\tIf
\nbreach of any of the above conditions is committed,  the Sessions
\nJudge concerned will be free  to take appropriate action in the
\nmatter.\n<\/p>\n
20.\tBail
\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n
\tRule
\nis made absolute.  Direct service is permitted.\n<\/p>\n
