State of Rajasthan through Public Prosecutor\n\nDate of Order :::  07.07.2010\n\nHon'ble Mr. Justice Mohammad Rafiq\n\nShri\tAjay Gupta, Counsel for petitioner\nShri\tAmit Punia, Public Prosecutor\n####\n\nBy the Court:-<\/pre>\n<p>Heard learned counsel for petitioner as well as learned Public Prosecutor and perused the material made available to me during the arguments of the case.\n<\/p>\n<p>Contention of learned counsel for petitioner is that the offence alleged against the petitioner is under Section 420 IPC for cheating the complainant of Rs.80,000\/-; petitioner was arrested on 17.04.2010 and investigation in the matter is complete; challan has already been filed; except this case, there is no other case registered against the petitioner; he would undertake not to indulge in any such or other offence in future; trial of the case is likely to take a considerable period.\n<\/p>\n<p>Learned Public Prosecutor opposed the bail application.\n<\/p>\n<p>After considering all the facts and circumstances of the case and without expressing any opinion on its merits and demerits, I deem it just and proper to release the accused-petitioner, namely, Karim Sayyad Son of Shri Abdul Sattar on bail under Section 439 Cr.P.C., in FIR No.61\/2010, Police Station Bagru, District Jaipur, under Section 420, IPC, provided he furnishes a personal bond in the sum of Rs.50,000\/- with two sureties of Rs.25000\/- each to the satisfaction of the trial court for his appearance on all subsequent dates of hearing and as and when called upon to do so.\n<\/p>\n<p>However, in case petitioner is found indulged in similar or any other offence at any point of time in future, the bail granted to him would be liable to be cancelled at the instance of the prosecution.\n<\/p>\n<p>The bail application stands disposed of.\n<\/p>\n<p>(Mohammad Rafiq) J.\n<\/p>\n<p>\/\/Jaiman\/\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Karim Sayyad vs State Of Rajasthan Through P.P on 7 July, 2010 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR ORDER IN S.B.
