Yadav waives service of RULE for<br \/>\n\trespondent No.1-Official Liquidator and learned Advocate Mr. M.G.<br \/>\n\tNagarkar waives for respondent No.2.\n<\/p>\n<p>This<br \/>\n\tis an application praying for extension of time for completion of<br \/>\n\tdemolition \/ dismantling work   removal of the assets purchased by<br \/>\n\tthe applicant. Vide order dated 16.04.2010 four months time was<br \/>\n\tgranted for the same on the condition that the applicant shall<br \/>\n\tdeposit \/ pay an amount of Rs.20,000\/= per month for the delayed<br \/>\n\tperiod.  Thereafter, once again the applicant prayed for extension<br \/>\n\tof time and the Court passed the following order on 27.12.2010.  The<br \/>\n\tsame is reproduced as under :-\n<\/p>\n<p> 1.<br \/>\n\tWithout going into any details of who is responsible for delay in<br \/>\n\tremoving superstructure, machinery and debris, petitioner is granted<br \/>\n\textension upto 28th February, 2011 to clear all the items<br \/>\n\tpurchased through Court auction.  Petitioner shall continue to pay<br \/>\n\tcharges @ Rs.50,000\/- per month as required by previous order passed<br \/>\n\tby this Court.\n<\/p>\n<p>2.<br \/>\n\tLearned Counsel for the respondents points out that more than<br \/>\n\tsufficient opportunities have already been granted to the applicant.<br \/>\n\t I am prima-facie in agreement with such contention. This extension<br \/>\n\tis, however, granted only in larger interest of justice and it is<br \/>\n\tclarified that petitioner should not expect any further extension.\n<\/p>\n<p>3.<br \/>\n\tApplication is disposed of accordingly.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Pranav G. Desai for the applicant submits that on<br \/>\n\taccount of genuine reasons and other problems, the work could not be<br \/>\n\tcompleted and therefore as a last opportunity, time may be extended<br \/>\n\tby a further period of four months.  There is no objection at the<br \/>\n\tend of Mr. Nagarkar appearing for respondent No.2 except the fact<br \/>\n\tthat according to him the period of four months is too long and the<br \/>\n\tsame may be reduced to three months.  The same request has been<br \/>\n\treiterated by Mr. Yadav.\n<\/p>\n<p>I<br \/>\n\thave heard Mr. Nagarkar for respondent No.2 and Mr. Yadav for the<br \/>\n\tofficial Liquidator   respondent No.1.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case and having regard to what<br \/>\n\thas been stated in the application, I deem it just and proper to<br \/>\n\tgrant three months time period to the applicant for completion of<br \/>\n\tdemolition \/ dismantling and removal of the assets purchased by the<br \/>\n\tapplicant.  Applicant is granted extension upto 31ST<br \/>\n\tMAY, 2011 to clear all the items purchased through court<br \/>\n\tauction.  The applicant shall continue to pay charges at the rate of<br \/>\n\tRs.20,000\/- per month as required by previous order passed by this<br \/>\n\tCourt.  It is clarified that this extension is for the last time in<br \/>\n\tthe peculiar facts and circumstances of the case.  There shall be no<br \/>\n\tfurther extension on any grounds.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid directions, this Company Application is disposed of<br \/>\n\taccordingly.
