(Oral)\n<\/pre>\n<p>               The petitioner, who is working as LDC in the respondent-<br \/>\nBoard, has filed the instant petition under Article 226 of the Constitution of<br \/>\nIndia for quashing the order dated 16.3.2009 (Annexure P2) whereby<br \/>\nrespondent No.3 has ordered to recover an amount of Rs.1,33,315\/- on<br \/>\nwithdrawal of the annual increments, which was withdrawn on the ground<br \/>\nthat the petitioner has not cleared the typing test as per the requirement of<br \/>\nthe respondent-Board.\n<\/p>\n<p>               In the written statement, it has been stated by the respondents<br \/>\nthat vide Circular dated 7.7.2009 the respondent-Board has given one more<br \/>\nchance to all those employees who have not cleared the typing test, and if<br \/>\nthey clear the typing test within six months, then no recovery will be<br \/>\neffected from them and they will also be released the increments, which<br \/>\nwere earlier stopped.\n<\/p>\n<p>               In view of the aforesaid stand taken by the respondents in the<br \/>\nwritten statement, at this stage the petition has become infructuous and the<br \/>\nsame is dismissed as such.\n<\/p>\n<pre>November 10, 2009                              (SATISH KUMAR MITTAL)\nvkg                                                    JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Jagjit Singh vs Punjab State Electricity Board on 10 November, 2009 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH C.W.P.
