K. Shah, learned AGP waives service of rule on behalf of the<br \/>\nrespondents. With the consent of the parties, the matter is taken up<br \/>\nfor final hearing today.\n<\/p>\n<p>1.\t\tBy<br \/>\nway of this petition, the petitioners have prayed to quash and set<br \/>\naside the impugned order 02.12.2009 passed by respondent no. 2,<br \/>\nwhereby respondent no. 2 directed the petitioners to stop their<br \/>\nmining activity.\n<\/p>\n<p>2.\t\tThe<br \/>\nshort facts of the case are that the petitioner-firm is engaged in<br \/>\nthe business of mining bauxite since last more than 28 years.  The<br \/>\npetitioner firm had applied for mining lease to the State Government,<br \/>\npursuant to which the petitioner firm was awarded mining lease vide<br \/>\norder dated 24.08.1992 for an area of 2 hectares in the river bed of<br \/>\nriver Mazum. Thereafter, lease deed dated 09.11.1982 came to be<br \/>\nentered into between the Government of Gujarat and the petitioner for<br \/>\na period of 20 years. Since the said lease period was to expire in<br \/>\n2000, the petitioner made an application on 08.11.2001 to  State<br \/>\nGovernment for renewal of mining lease, which is reportedly  pending.<br \/>\nHowever, in view of the provisions of  Rule 24A(6) of the Mineral<br \/>\nConcession Rules, 1960 the mining lease is deemed to have been<br \/>\nextended and therefore, is presently in existence.\n<\/p>\n<p>2.1.\t\tOn<br \/>\n14.11.2008, the petitioner firm deposited an amount of Rs.2,50,000\/-<br \/>\nwith the State Government towards advance royalty for getting duly<br \/>\nstamped royalty passbooks issued in its favour. However, the<br \/>\npetitioner firm was not issued the said royalty passes by the<br \/>\nrespondents authorities. Thereafter, the petitioners, made several<br \/>\nrepresentations to the respondents for issuance of the royalty passes<br \/>\nbut, the same were not considered.  Therefore, the petitioners<br \/>\napproached this Court by way of Special Civil Application No. 10489<br \/>\nof 2008. This Court vide order dated 05.11.2009 admitted the petition<br \/>\nand granted ad-interim relief to the effect that the concerned<br \/>\nauthority shall take all necessary actions for issuance of royalty<br \/>\npassbooks to the petitioners. Pursuant to the order of this Court,<br \/>\nthe concerned authority instead of issuing royalty passbooks for the<br \/>\namount of Rs.2,50,000\/- issued only one royalty passbook of Rs.<br \/>\n41,000\/-.\n<\/p>\n<p>2.2.\t\tThereafter<br \/>\nrespondent no. 1 carried out  inspection of the land leased in favour<br \/>\nof the petitioners.  Pursuant thereto, respondent no. 1 on 19.11.2009<br \/>\nissued Notice to the petitioners alleging that the petitioners had<br \/>\ndispatched bauxite  without payment of royalty. Subsequently,<br \/>\nrespondent no. 2 vide order dated 02.12.2009, directed the<br \/>\npetitioners to stop their mining activity with immediate effect.<br \/>\nHence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties. It is the case of the<br \/>\npetitioners that before passing the impugned order dated 02.12.2009,<br \/>\nthe respondent no. 2-authority has not afforded any opportunity of<br \/>\nhearing to the petitioners and has straightaway passed the said order<br \/>\ndirecting the petitioners to stop the mining activities. On perusal<br \/>\nof the record, I find substance in the said contention raised by the<br \/>\npetitioners. Learned AAG appearing on behalf of respondent no. 2<br \/>\nauthority is not in a position to show from the record that the<br \/>\npetitioners were heard before passing the impugned order dated<br \/>\n02.12.2009. Thus, it has to be said that the impugned order dated<br \/>\n02.12.2009 passed by respondent no. 2-authority is in violation of<br \/>\nthe principles of natural justice. In the fitness of things, it would<br \/>\nbe appropriate that respondent no. 2-authority decides the issue<br \/>\nafresh, after giving due opportunity to the petitioners to present<br \/>\ntheir case.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above discussion, the impugned order dated 02.12.2009<br \/>\npassed by respondent no. 2-authority will be treated as a notice to<br \/>\nthe petitioners. The petitioners will file their reply to the said<br \/>\nnotice within a period of ten days from today. On receipt of such<br \/>\nreply from the petitioners, the respondent no. 2-authority shall fix<br \/>\na date of hearing, which may be convenient to both the sides and<br \/>\nwill, thereafter, proceed with the matter on the date so fixed. After<br \/>\ngiving due opportunity to the petitioners to present its case,<br \/>\nrespondent no. 2-authority will render its decision, within a period<br \/>\nof eight weeks thereafter. Till the final decision is rendered by<br \/>\nrespondent no. 2. the stay on the mining activities imposed by<br \/>\nrespondent no.2-authority will remain in abeyance on condition that<br \/>\nthe petitioners will furnish all details regarding the materials<br \/>\nshifted from the site in question and will make necessary payment<br \/>\ntowards the royalty thereof to respondent no.2-authority before the<br \/>\nfinal decision is rendered.\n<\/p>\n<p>5.\t\tWith<br \/>\nthe above observations, the petition stands disposed of. Rule is made<br \/>\nabsolute to the aforesaid extent.
