Original
\n\tpetitioner has challenged award made by labour court, Ahmedabad in
\n\tReference NO. 33 of 1991 dated 20.8.2001 wherein labour court has
\n\tpartly allowed reference with a direction to petitioner to reinstate
\n\trespondent workman in service with 50 per cent back wages for
\n\tinterim period with continuity of service.\n<\/p>\n
In
\n\tpetition, initially, notice was issued to petitioner and
\n\tsubsequently on 10.11.2003, rule was issued by this court. Pending
\n\tpetition, subject to compliance with section 17B of ID Act, 1947, it
\n\twas directed that there shall be ad interim stay in terms of
\n\tparagraph 6(B) of ID Act, 1947. Thus, by way of an ad interim relief
\n\tgranted by this court, implementation of award was stayed by this
\n\tcourt subject to compliance of section 17Bof ID Act, 1947.\n<\/p>\n
According
\n\tto workman, he was appointed in April, 1986 as watchman and remained
\n\tin service upto 13th June, 1990 and thereafter, his
\n\tservice was terminated, therefore, he raised an industrial dispute
\n\twhich was referred to labour court for adjudication. Labour Court
\n\tAhmedabad has come to conclusion that at the time of terminating
\n\tservice of respondent workman, section 25F of ID Act, 1947 has not
\n\tbeen complied with by petitioner and workman has not left job at his
\n\town and, therefore, order of termination has been set aside by
\n\tlabour court. Considering gainful employment to some extent and not
\n\tmade sincere efforts for getting job, labour court granted only 50
\n\tper cent back wages for interim period while keeping in mind fact
\n\tthat there are six family members, out of them, two are daughters
\n\tand one son, doing miscellaneous work in one bungalow.\n<\/p>\n
Civil
\n\tApplication No. 13349  of 2009 is filed by respondent workman with a
\n\tprayer to grant last drawn wages to respondent workman with effect
\n\tfrom date of award against which counter has not been filed by
\n\tpetitioner. In Civil Application, respondent workman has made
\n\tspecific averment that he is unemployed, not gainfully employed, in
\n\tparagraph 5 and also filed affidavit to that effect  dated
\n\t15.12.2009 annexure B page 8.\n<\/p>\n
Today,
\n\twhen civil application was taken up for hearing, it is jointly
\n\tsubmitted by learned Advocates for both parties that the parties to
\n\tthis petition have arrived at amicable settlement in respect to main
\n\tspecial civil application No. 6807 of 2002. According to terms of
\n\tsettlement, petitioner establishment is prepared to reinstate
\n\trespondent workman  in service with continuity of service and as
\n\tagainst claim for 50 per cent back wages for interim period from
\n\tdate of termination till date of award and claim for 17B wages from
\n\tdate of award till date of reinstatement, petitioner is prepared to
\n\tpay lumsum amount of Rs.50,000.00 (Rupees fifty thousand only) to
\n\trespondent workman. These terms of settlement have been explained by
\n\tlearned Advocate Mr. Joshi to respondent workman Shri Vaghajibhai
\n\tOkhabhai Rabari who is present before this Court and he has accepted
\n\tthe same in full and final settlement of award made by labour court,
\n\tAhmedabad.\n<\/p>\n
Therefore,
\n\tin light of this discussion and amicable settlement arrived at
\n\tbetween the parties, as aforesaid, it is directed to petitioner to
\n\treinstate respondent workman Shri Vaghajibhai Okhabhai Rabari in
\n\tservice with continuity of service within period of one week from
\n\tdate of receipt of copy of this order. It is directed to petitioner
\n\tto pay current daily wages to respondent workman from the date of
\n\this reinstatement.\n<\/p>\n
In
\n\tlieu of the claim for 50 per cent back wages as awarded by labour
\n\tcourt for interim period from date of termination of service of
\n\trespondent workman till date of award as well as the claim for
\n\tbenefit under section 17-B of ID Act from date of award till
\n\t8.4.2010, it is directed to petitioner to pay lumsum amount of
\n\tRs.50,000.00 (Rupees fifty thousand only) to respondent workman
\n\tVaghajibhai Okhabhai Rabari by way of an account payee cheque drawn
\n\tin favour said respondent workman, after proper verification, within
\n\tfour weeks from date of receipt of copy of this order.\n<\/p>\n
Accordingly,
\n\taward passed by labour court, Ahmedabad in Reference No. 33 of 1991
\n\tdated 20.8.2001 is modified and rule is made absolute accordingly in
\n\taforesaid terms with no order as to costs.\n<\/p>\n
Therefore,
\n\tas a consequence of this settlement arrived at between the parties,
\n\tnow, respondent workman shall have to withdraw two proceedings filed
\n\tby him against present petitioner namely Payment of Wages
\n\tApplication NO. 38 of 2006 and 25 of 2002 and he shall have to
\n\twithdraw any other application, if any, filed by him against present
\n\tpetitioner for implementing award made by labour court. Said two
\n\tapplications and any other proceedings filed by the respondent
\n\tworkman are required to be withdrawn by respondent workman within
\n\tperiod of fifteen days from date of receiving copy of this order and
\n\tcopy of withdrawal is to be given by respondent workman to
\n\tpetitioner. It is made clear that the aforesaid order has been
\n\tpassed by this court modifying award by labour court, against all
\n\trights of respondent workman arising from award passed by labour
\n\tcourt and therefore, that has to be considered as full and final
\n\tsatisfaction of award. Parties to this proceeding are directed to
\n\tabide by the settlement arrived at between them, as recorded by this
\n\tcourt.\n<\/p>\n
In
\n\tview of the aforesaid order passed by this Court in main special
\n\tcivil application, civil application No. 13349 of 2009 also stands
\n\tdisposed of with no order as to costs.\n<\/p>\n
