DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\n\tapplication is preferred by the mother of the applicant &#8211; an<br \/>\n\tunder trial prisoner who is arrested on 23.05.2009 for the offences<br \/>\n\tpunishable under Sections 302 and 34 of the Indian Penal Code and is<br \/>\n\timprisoned at the Sabarmati Central Jail.\n<\/p>\n<p>\tIn<br \/>\n\tthis application, the mother of the applicant appears and has<br \/>\n\tproduced a Medical Certificate issued by a qualified surgeon which<br \/>\n\treveals that the wife of the applicant is to undergo hysterectomy<br \/>\n\tand she is under the surgeon&#8217;s treatment and further, the operation<br \/>\n\tis scheduled on August 5, 2011.\n<\/p>\n<p>Considering<br \/>\n\tthe ailment of the wife of the applicant &#8211; an under trial<br \/>\n\tprisoner and the medical<br \/>\n\tcertificate which has been verified by the Police Sub Inspector,<br \/>\n\tSatellite Police Station, Ahmedabad City, I deem it just and proper<br \/>\n\tto grant  fifteen (15)<br \/>\n\tdays of temporary<br \/>\n\tbail to the applicant &#8211; an under trial prisoner, from the date<br \/>\n\tof his release, on furnishing a surety of Rs.5,000\/= (Rupees Five<br \/>\n\tThousand Only) to the satisfaction of the jail authority.  During<br \/>\n\tthe period of temporary bail, the applicant &#8211; an under trial<br \/>\n\tprisoner shall mark his presence once in a week before the Satellite<br \/>\n\tPolice Station, Ahmedabad City.<br \/>\n\t  On completion of the period of temporary bail, the applicant &#8211;<br \/>\n\tan under trial prisoner shall surrender in time before the jail<br \/>\n\tauthorities.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid observation and direction, this application stands<br \/>\n\tdisposed of.
