No.4317 of 2007)\n\n\nDinesh Kumar Srivastav and Ors.                                 ...Appellant(s)\n\n\n                                      Versus\n\n\nSwati Sinha and Anr.                                            ...Respondent(s)<\/pre>\n<pre>                                O    R    D     E    R\n\n\n         Leave granted.\n         During       the     pendency         of     this      matter,       a     joint\napplication     has    been    filed     by     Dinesh        Kumar    Srivastav      and\nSwati Sinha under Section 13-B of the Hindu                           Marriage       Act,\n1956,   [for    short,      `the    Act'].      It       is   stated    in    the    said\napplication     that,       during       the        pendency     of     the       present\n<\/pre>\n<p>petition, the parties have decided to put an end to their<br \/>\nmatrimonial relationship and filed the present application<br \/>\nfor seeking mutual divorce under under Section 13-B of the<br \/>\nAct.     In the application, it is mentioned that both the<br \/>\nparties shall withdraw the civil and criminal proceedings<br \/>\ninitiated by them against each other in various Courts.                               Let<br \/>\nit be done within four weeks from today.\n<\/p>\n<p>         The      appellant-Dinesh            Kumar      Srivastav      has    given    a<br \/>\nbank    draft   of    Rs.1.25       lakhs      to    Swati     Sinha    towards       her<br \/>\nmaintenance and Rupees one lakh has been deposited in the<br \/>\nname of his daughter-Shivani Sinha under the guardianship of<br \/>\nher mother Swati Sinha.\n<\/p>\n<p>                                                                                  &#8230;.2\/-\n<\/p>\n<p>                                      &#8211; 2 &#8211;\n<\/p>\n<p>         The    appellant-Dinesh         Kumar       Srivastav      has     further<br \/>\nagreed to pay Rupees two thousand per month to Swati Sinha<br \/>\ntowards monthly educational expenses of his daughter Shivani<br \/>\nSinha.   He has also undertaken to pay the same till Shivani<br \/>\nattains the      age   of     18   years.      The    amount   of     Rupees      two<br \/>\nthousand shall be paid to Swati Sinha by an account payee<br \/>\ncheque\/draft every month by 15th day of each calendar month.<br \/>\nIt may be stated that the amount of Rupees two thousand would<br \/>\nbe paid from the month of November, 2009 onwards.\n<\/p>\n<p>         The     appellant-Dinesh           Kumar     Srivastav       would        be<br \/>\nentitled to spend two hours with his daughter on second and<br \/>\nfourth        Saturdays\/Sundays        of     every    month     at   the     place<br \/>\nwherever she stays with Swati Sinha.
