Justice ANTONY DOMINIC\n\n Dated :24\/01\/2011\n\n O R D E R\n                     ANTONY DOMINIC, J.\n                       -------------------------\n                 W.P (C) No.38161 of 2010\n                      --------------------------\n              Dated this the 24th January, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>      The writ petition has been filed seeking a direction<\/p>\n<p>commanding the 1st respondent to allow Exts.P8 to P10<\/p>\n<p>applications by including the name of the petitioners in the<\/p>\n<p>Electoral Roll of the Peermedu Assembly Constituency.<\/p>\n<p>Consequential reliefs are also sought for. According to the<\/p>\n<p>petitioners, they submitted Exts.P8 to P10 applications<\/p>\n<p>before the 1st respondent producing Exts.P1 to P7, seeking<\/p>\n<p>their inclusion in the voters list. It is stated that though<\/p>\n<p>they were called for hearing, orders were not passed for<\/p>\n<p>their inclusion. It is complaining of the above, the writ<\/p>\n<p>petition has been filed.\n<\/p>\n<p>      2.   A statement has been filed on behalf of the 1st<\/p>\n<p>respondent which says that Exts.P8 to P10 applications<\/p>\n<p>submitted by the petitioners were rejected by the Electoral<\/p>\n<p>Registration Officer on 17.12.2010 for the reason that the<\/p>\n<p>petitioners did not produce the         residential certificate,<\/p>\n<p>ration card or other relevant documents to prove that they<\/p>\n<p>were ordinarily residents of the Peerumedu Assembly<\/p>\n<p>W.P (C) No. 38161 of 2010<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>Constituency. Reference is also made by Ext.P6. Further<\/p>\n<p>the claim made by the petitioners that by Exts.P11 to P13<\/p>\n<p>notices of hearing were served at the addresses furnished<\/p>\n<p>by the petitioners is also disputed. It is stated that now the<\/p>\n<p>remedy available to the petitioners is either to make fresh<\/p>\n<p>applications in Form No.6 of the Registration of Electors<\/p>\n<p>Rules 1960 by producing necessary documents to prove<\/p>\n<p>that  they    are   ordinarily  residents    of     Peermedu<\/p>\n<p>Constituency or to file appeal before the District Collector<\/p>\n<p>under Rule 23 of the said Rules. The allegation that the<\/p>\n<p>application has been rejected under the influence of one<\/p>\n<p>Jeswant Lal is also denied by the 1st respondent.<\/p>\n<p>     3.    Learned standing counsel appearing of the 1st<\/p>\n<p>respondent produced before me the applications made by<\/p>\n<p>the petitioners duly endorsed by the 1st respondent to the<\/p>\n<p>effect that petitioners could not produce the documents to<\/p>\n<p>substantiate their claim.\n<\/p>\n<p>     4.    Pleadings in the writ petition show that what<\/p>\n<p>was relied on by the petitioners to substantiate their claims<\/p>\n<p>was Exts.P1 to P6. These documents are the extracts of<\/p>\n<p>W.P (C) No. 38161 of 2010<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>the    bank passbook,    LPG Diary, residential certificate<\/p>\n<p>issued by the Sub Inspector of Police, order issued by the<\/p>\n<p>Peruvanthanam Grama Panchayat etc. However, from the<\/p>\n<p>endorsement on the applications what is seen is that these<\/p>\n<p>documents were not produced by the petitioner. On the<\/p>\n<p>other hand, according to the 1st respondent, petitioners did<\/p>\n<p>not produce the ration card or residential certificate issued<\/p>\n<p>by the competent authority.          Further, referring to<\/p>\n<p>documents available with him, the standing counsel further<\/p>\n<p>submits that the residential certificate earlier issued by the<\/p>\n<p>Secretary of the Panchayat was cancelled by the Panchayat<\/p>\n<p>itself.\n<\/p>\n<p>      5.   Evidently therefore, petitioners can       succeed<\/p>\n<p>only if they succeed in proving the factual issue that they<\/p>\n<p>are the residents of the place as claimed by them. On<\/p>\n<p>appreciation of the materials produced             if the 1st<\/p>\n<p>respondent has rejected the said contention, the remedy<\/p>\n<p>available to the petitioners is to prefer an appeal against<\/p>\n<p>such an order. I take this view for the further reason that<\/p>\n<p>it is not possible for this Court to appreciate the factual<\/p>\n<p>W.P (C) No. 38161 of 2010<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>contentions    raised by the petitioners in a proceedings<\/p>\n<p>under Article 226 of the Constitution of India..
